사회정의의 사회보장법적 표상

Social security law is a legal system that helps people who copes with social risks and maintains dignity in his/her life. The social security system functions as a redistribution system of income in the nation as a whole and maintains social tranquility through individual stability. As social security law is recognized as a national system for the distribution and transmission of goods and cash for the individual's survival care, the character of the law as mutual rights and obligations becomes blurred, and the meaning of social justice, which is considered to be the law's representation, also became unclear. With social security law overall managing the lives of individuals in society, most people are now in the social security system, In particular, for those who lack the capacity to live on their own, the social security law serves as a benefit provider for their survival. However, the problem of forced or transactional situation arising from the delivery of such benefit, which is considered good, is overlooked. In this article, we review the implications of the Social Security Act as a distribution and delivery system of benefit by the state. We also propose the duty of others and solidarity responsibility as a symbol of justice that can affirm social redistribution and try to overcome reification(objectification) of personality and labour in the benefit delivery system.
