기후변화 대응을 위한 영국기후변화법의 분석을 통한 한국 기후변화대응법제 마련에 대한 시사점

The Paris Convention, an international treaty on climate change, has highlighted the importance of climate change adaptation in addition to reducing GHG emissions worldwide. However, since the Low-carbon Green Growth Basic Law is not effective in promoting climate change adaptation policy in Korea, complementary legislation is needed. As mentioned above, the UK Climate Change Act can provide useful implications for Korea's climate change adaptation legislation. In particular, Korea should pay attention to the preparation and evaluation of periodical national reports, organic information exchange and cooperation among related ministries, advice from the Committee on Climate Change, public comments, increase transparency through publication of national reports and the pursuit of adaptive policies for systematic and substantial climate change under the UK Climate Change Act. However, since the vulnerability to climate change varies by country and region, the climate change adaptation should be accompanied by national and regional efforts. It would be ideal, especially if there is a legitimate basis for strengthening the adaptive capacity of local governments that are vulnerable to climate change and, if necessary, supporting the central government. The current draft Climate Change Response Act requires the head of the local governments to establish and implement an annual climate change response implementation plan in accordance with the Comprehensive National and Regional Comprehensive Plan. The central government and local governments all agree that basic local governments should also work to counter climate change. However, considering that the bill requires the establishment and enforcement of the comprehensive national plan(Article 8), the Central Implementation Plan(Article 9), the Comprehensive Plan and the Metropolitan City Plan(Article 10), the obligation to establish and enforce the implementation plan is likely to be a somewhat excessive administrative burden in the present situation where the conditions such as finance are different. However, it is expected that reasonable and effective climate change adaptation policy will be established and implemented by the enactment of the Climate Change Response Act reflecting these considerations. Above all, in addition to mitigation of climate change, it will be possible to establish and respond to a deeper legal basis for climate change through raising awareness of climate change adaptation and expanding adaptation budgets.
