이 논문에서는 최근 제기된 법과 감정의 관계에 대한 새로운 시각과 성찰에 주목하여 이를 동아시아 법사학 연구에 활용할 수 있는 가능성을 살펴보고자 했다. 최근 마사 누스바움(Martha C. Nussbaum)의 논의는 ‘법과 감정의 관계’에 관한 연구로서 가장 주목받고 있는 연구이다. 누스바움은 법적 판단에서 문학적 상상력과 합리적 감성이 필수적임을 역설하면서 근대법의 지나친 이성주의와 추상적 보편주의가 오히려 인간의 구체적 현실과 정의 실현을 외면하는 모순에 빠질 수 있음을 비판한다. 그런데 누스바움의 논의와 유사하게 유교적 사법전통에서도 ‘법과 정’ 혹은 ‘정·리·법’의 관계가 중요하게 다루어졌다는 사실은 비교법사학의 관점에서 매우 흥미로운 사실이 아닐 수 없다. 다만 유교적 사법전통에서는 덕치 및 예치의 중시가 법의 공평성과 보편성을 약화시키는 결과를 초래하지 않도록 ‘법과 정’의 균형을 유지하는 것이 무엇보다도 중요한 과제가 되었다. 이처럼 감정의 인지적 기능을 강조한 감정 이론은 동아시아 사법전통과 현대 동아시아 법문화를 폭넓게 이해하고 통찰하는 데에도 새로운 실마리를 제공할 것이다.
Abstract
This article aims to introduce new perspectives on and insights into the relationship between law and emotion and to examine how to utilize these approaches in the field of East Asian legal history. Regarding the relationship between law and emotion, the recent arguments made by Martha C. Nussbaum have received much scholarly attention. Nussbaum contends that literary imagination and emotional rationality are necessary for sensible legal judgments, because the excessive rationalism and abstract universalism of modern law may paradoxically neglect concrete human existence and even obstruct the realization of justice. Her arguments seem very interesting from the perspective of East Asian legal history, because the relationship between law and emotion or the qing·li·fa relationship was considered vital in the Confucian legal tradition. However, balancing law and emotion was the most difficult task in the Confucian legal tradition, inasmuch as the emphasis on moralistic or ritualistic norms might have attenuated the equity and universality of law. Furthermore, the recent cognitive approaches to emotions will provide us with new perspectives for a broad understanding of the East Asian legal tradition and contemporary East Asian legal culture.
