일본의 3단계 전기요금 누진제 - 우리나라 누진제와의 비교 및 시사점 -

초록

본고는 ‘전기요금 누진제’(누진요금제)의 유래와 법적 근거 및 그 운용의 합리적 범위를 판단하기 위한비교법적 자료를 제공하기 위한 것이다. 결론적으로 우리나라의 전기요금제도는 일본 전기사업법상‘총괄원가주의’에 입각한 요금산정방식 및 ‘인가제’를 그대로 계수한 것이고, 누진요금제 역시 1973년의제1차 석유파동(오일쇼크) 후에 일본에서 창설한 ‘누진요금제(체증요금제)’를 그대로 참고하여 도입한것이다. 그러나 일본의 누진요금제는 누진단계를 3단계에 고정하고 누진율도 1.6배 이내에서 안정적으로운용해온 반면, 우리나라에서의 제도 운용은 누진단계를 최대 12단계까지, 누진율도 최대 19.7배까지확대적용한 시기가 있었고 가정용전기에만 누진제를 도입하는 등 일본의 제도운용과는 상당한 차이를보여왔다. 그럼에도 불구하고 제도도입의 이론적 근거로 전기요금산정기준고시에 명시된 ‘자원의 효율적배분’의 의미가 명확하지 아니한 문제가 있다. 무엇보다 법령상 전기요금산정의 대원칙인 총괄원가방식은어디까지나 ‘비용원리’에 입각한 것이라는 점에서 고시에서 ‘효용원리’에 입각하여 전기요금 누진제의근거를 찾고자 하였다면 이것은 위임입법의 한계를 넘을 수 있는 위험이 있다. 이러한 전제에 선다면 다른입증이 없는 한 우리나라의 전기요금 누진제는 전기사업법의 이념인 전기사용자의 이익 보호(제1조)와부담의 형평의 원칙(전기요금산정기준고시 제14조 제1항)에 반하도록 운용되어 왔다는 비판에서 자유로울수 없을 것으로 본다. 본고의 검토가 우리나라 전기요금 누진제를 정확하게 이해하기 위한 기초자료로서누진제의 개편을 둘러싼 논의 및 관련 소송의 해결에 조금이라도 도움이 되기를 기대한다.

Abstract

This paper is intended to provide comparative legal data for judging the origin, legal basis and the reasonable scope of its operation of the ‘Progressive Electricity Rate System’. In conclusion, the nation's electricity rate system is based on ‘general cost principle’ and the licensing system under Japan's Electricity Business Act, and the progressive rate system is also adopted by referring to the Japanese progressive rate system established in Japan after the first oil shock in 1973. However, while Japan's progressive rate system has fixed the progressive phase in three stages and the progressive rate has been stable within 1.6 times, the system in Korea has expanded the progressive phase up to in 12 stages, the progressive rate up to 15 times and introduced the progressive system only for household electricity. Nevertheless, there is a problem where the meaning of the 'efficient allocation of resources' specified in the Notification of Electricity Rates is not clear as the theoretical basis for the introduction of the system. Above all, in view of the fact that the general cost method, which is the grand principle of calculating electricity rate under the statute, is based on the 'cost principle', there is a risk that defining the progressive system of electricity rate based on the 'utilization principle' in the Notification of electricity rates may exceed the limit of the delegated legislation. Given this premise, we cannot be free from the criticism that the nation's progressive system has operated against the principle of protecting the interests of electricity users, which is the ideology of the Electricity Business Act, and the principle of banning discrimination. I hope that the review of this paper will help the discussion surrounding the reorganization of the progressive rate system and the resolution of related lawsuits as basic data to accurately understand the nation's progressive electricity rate system.This paper is intended to provide comparative legal data for judging the origin, legal basis and the reasonable scope of its operation of the ‘Progressive Electricity Rate System’.
