초록
현재 국내에서 자치경찰제 도입을 위한 다양하고 활발한 논의가 전개되고 있으나, 자치경찰제도 시행으로 중앙의 통제에서 벗어나는 지역경찰이 가지고 있는 권한 및 실무에 대한 감사, 통제 및 책임성(accountability)과 관련한 학계의 논의는 활발하지 않았다. 이에 이 연구에서는민주성 및 독립성을 중심으로 자치경찰의 일반적인 특성 및 문제점을 분석하고, 자치경찰제도를운영하고 있는 미국에서 연방정부가 자치경찰 책임성 강화를 위해 활용하고 있는 방안들을 검토하며, 이러한 방안들이 자치경찰의 일반적인 특성 및 문제점과 어떠한 관계를 맺고 있는지 고찰하였다. 특히, 이 연구에서는 ‘자치경찰직무집행 연방조사제도’(pattern-or-practice investigation) 와 경찰 관련 정부 보조금을 중심으로 미국 연방정부의 자치경찰 통제 기제를 검토하였다. 자치경찰직무집행 연방조사제도는 연방 법무부가 조사를 하고 법원에 소송을 제기하는 등 문제가되는 특정 경찰관서에 대해 완전한 변혁을 시도하며, 정부 보조금의 경우 자치경찰의 업무 범위등에 대한 사전적이며 체계적인 통제가 가능하다. 이 연구에서는 이러한 경찰 통제 기제들이 한국 자치경찰 도입에 어떠한 함의를 갖는지를 논의하였다.
Abstract
Although there are various discussions on the introduction of autonomous police system, discussions on the authority, responsibility and accountability of the local police were not discussed enough. The purpose of this study is to review the general characteristics and problems of autonomous police systems, to examine the ways in which the federal government of the United States implementing the autonomous police system, and what kind of relationship it has with the problems of autonomous police systems. In particular, we examined the local police control mechanism of the US federal government, focusing on pattern-or-practice investigation and Federal government grants for police. The pattern-or-practice investigation attempts to make a complete change for a particular police department. In the case of government grants, various problems are pointed out, but it is possible to control the scope of the autonomous police practices in advance. In this study, we discussed the implications of these police control mechanisms on the introduction of Korean autonomous police.
