본 연구는 사회복지법인과 생활시설의 특정경제범죄법상 횡령·배임죄의 판결분석을 통해 사회복지분야의 양형 문제를 분석하고 그 대안을 제시하고자 실시되었다. 연구대상은 2010-2018년까지의 4개의 사건에 대한 10개의 판결문이며, 판결문 속 범죄자는 5명이었다. 연구결과 기재방법의 문제 등으로 양형사유가 명확하지 않고, 사회보장급여와 보조금의 공공성, 사회복지종사자의 인권보장 의무 등 사회복지 분야의 특성을 고려하지 않고 일반기업과 같은기준으로 적용되는 양형인자 적용의 문제 및 처벌을 낮추는 데 작량감경이 사용되고 있음을 발견하였다. 이를 통해 다음과 같은 대안을 제시하였다. 첫째, 사회복지분야 사건은 일반 기업범죄와는다른 양형기준이 적용되어야 하며, 둘째, 사회복지종사자가 인권보장의무를 위배한 경우 가중처벌이 필요하며, 셋째, 양형인자들의 우선순위를 정해야 하고, 마지막으로 판결문에 작량감경을 포함한 양형이유를 충분히 납득할 수 있도록 충실히 기재되어야 한다. 본 연구는 그동안 연구가 부족했던 사회복지분야의 횡령·배임죄 판결분석을 통해 양형기준 뿐만 아니라 작량감경 사유와 문제점를찾고 그 대안을 제시하였다는 데 의의가 있다.
Abstract
This research was realized to analyze the punishment determination problem of social welfare and present its alternative through the punishment determination analysis of embezzlement and trust breach according to specific economic crime of social welfare foundation and residential facility. The research was made for 10 sentences of 4 cases judged from 2010-2018, and the number of criminals in the sentence was 5. Through a result of research, the following alternative was presented. First, for social welfare related case, the different basis of punishment determination from the common company crime should be applied; second, the additional penalty should be given when the social welfare worker violates the safeguard obligation for human rights; third, the priority of punishment determination factors should be determined; and finally the punishment determination reason should be mentioned in the sentence for enough understanding. This research looked for not only the punishment determination basis but also the reason and problem of mitigation of punishment in extenuation of circumstances and presented its alternative through the judgment analysis of embezzlement and trust breach of social welfare area that have not been much studied so far.
