국제운용리스계약상 임대인(Lessor)의 의무에 관한 연구 : DCFR상 물품임대차 계약편을 중심으로

This is an analytical study which comprises of the analysis of the rules of the obligations of the lessor under international operating lease contracts under the Draft Common Frame of Reference(here-in-after the DCFR). A purpose of this study is to examine all the rules as to the lessor’s obligations of international operating lease contracts under the DCFR and a specific focus is placed on the following obligations; first, an obligation to make the goods available for the lessee’s use at the lease period and at the place agreed; second, an obligation to ensure that the goods conform with the contract at the start of the lease period, third, an implied obligation to ensure that the goods fit for purpose, qualities, packaging and etc, fourth, an obligation as to incorrect installation under a consumer contract for the lease of goods, fifth, an obligation to cooperate the lessee to return the goods. On the basis of such examination, another purpose is to provide legal and practical advice to the contracting parties when they intend to insert the DCFR in their contract as a governing law.
