특수형태노무제공자 고용보험 적용의 쟁점 ― 기업의 경계변화에 조응하는 종속노동의 보호라는 관점에서 ―

This article examines the issues on how to provide all workers including dependent contractors, regardless of employment status, with protection of employment insurance system. First, I suggest the indicators that establish the scope of dependent contractors who shall be provided for protection of employment insurance. Second, I provide an typology of dependent contractors' labour, which is involved with consignment of work, possession of work equipment, inclusion of labour intermediary and supply chains. Furthermore, I explore who shall take responsibility for cost of employment insurance system and how to make ‘users’(in other words, economic employer) liable for insecurity of work and remuneration. In conclusion, I argue how employment insurance system shall be redesigned to protect all workers regardless of employment status.
