초록
이 연구는 중국의 1990--2017년 증권 허위진술 민사배상 사건을 체계적으로 정리하여 분석하고자 한다. 일선 법관과 변호사의 인터뷰를 조사하고, 대량 실증 데이터를 바탕으로 이러한 사건의 소송 메커니즘을 보완하는데 대해 제안하고자 한다. 현재 허위진술 민사상 배상 사건은 주로 최고인민법원의 사법해석을 통해 규범화되고 있다. 수년 동안 사법의 실천으로 검증된 성숙한 내용을 법으로 승급시켜야 하며, 입법을 개선하여 최상층 설계에 응답하고 심리 실무에서 드러난 문제점을 개선하며, 법을 집행하는 과정에서 진정으로 “유법가의(有法可依) ”를 해야 한다. 동시에 국제적인 접목에도 신경 써야 한다. 제적인 경험을 배우는 기초 위에 중국의 국정에 발을 들여놓고, 국제적인 규칙에 적응하고, 증권시장과 증권법 선진국과의 격차를 좁혀야 한다. 법 시행 과정에 국가는 입법의 허점을 보완하고, 이러한 사안의 구성 요건을 명확히 제시하고, 전문가 증인 제도를 도입하고, 거증 책임을 재분배하고, 소송 방식을 보완하고, 소송 절차를 최적화할 필요가 있다.
Abstract
This paper research the civil cases of misrepresentation of the stock market from 1990 to 2017 of our country. We interview the judges and lawyers and collect useful information on the basis of a large number of empirical data of such cases litigation mechanism perfect recommendations. The cases mainly by the Supreme Court's judicial explanation to the specification, should be more than a decade the judicial practice of a validated, mature content increased to law, improve legislation, response on the top design and improve the problems exposed in the trial practice, the real legal enforcement process. At the same time should pay attention to in line with international standards, the use of advantage of backwardness in learning based on the situation of our country, on the basis of international experience to adapt to the international rules, shorten the gap with the securities market and the securities law developed countries. Law we need to catch up on legislative loopholes in time, in the operation of the specific components of such cases, the introduction of expert witness system, and to reallocate the burden of proof, perfecting the litigation mode, optimization procedure.
