향후 경제발전의 성패를 좌우할 근간이 될 것으로 전망되는 4차 산업혁명과 관련하여 특히 저작물의 이용이 필요한 분야로서 소재검색 서비스, 정보해석 서비스, AI에 의한 심층학습, 리버스엔지니어링 분야 등이 꼽히고 있다. 이러한 기술은 텍스트마이닝 및 데이터마이닝(TDM)과 밀접하게 연관되어 있는데, TDM 기술은 그것을 활용하는 과정에서 필연적으로 대량의 정보를 취급하게 되고, 그로 인하여 저작권법 등 기존의 법과 상당한 긴장관계를 연출하게 된다. 특히 저작권법과 관련하여 TDM 기술의 활용과정에서 부득이하게 대량의 정보에 대한 접근, 수집, 저장, 처리, 변형, 전송 등의 행위가 일어날 수 있는데, 이들 정보에 저작물을 비롯한 저작권법이 보호하는 정보가 포함되어 있을 경우 저작권침해의 문제가 발생하게 된다. 그런데 현재의 저작권법은 권리제한규정에서 저작권자의 허락 없이 저작물을 이용할 수 있는 경우를 그 이용의 목적 등에 따라 일정하게 매우 한정적으로만 규정하고 있다. 이러한 저작권법의 한계로 인하여 TDM은 4차 산업혁명에 성공적으로 진입하기 위하여 반드시 필요한 행위이고 경제적‧산업적으로 공공의 이익에 대한 기여도가 높은 행위임에도 불구하고 권리제한규정에 명백히 해당하지 않아 저작재산권 침해의 책임을 질 수 있게 된다. TDM 기술의 발전과 저작권의 조화와 균형을 이루고자 하는 입법적 시도는 2010년 이후 영국과 일본에서 활발하게 이루어졌다. 이 논문에서는 TDM 기술의 발전과 저작권법과의 긴장관계를 어떻게 조율하여야 할 것인지, 저작권법에 TDM과 관련된 새로운 저작재산권 제한규정을 도입할 필요성은 없는지, 필요성이 있다면 그 구체적 내용은 어떻게 설정되어야 할 것인지 등에 관하여 영국과 일본에서의 입법과정에서의 시사점을 바탕으로 살펴본다.
Abstract
The 4th industrial revolution, which is supposed to be the basis for future economic development, is closely related to text and data mining(TDM). TDM technology inevitably deals with a large amount of information, thereby creating a significant tension with existing laws such as copyright law . In particular, in the process of using TDM technology, inevitable accessing, collecting, storing, processing, transforming, and transmitting large amounts of information may occur the problem of copyright infringement. However, current copyright law provides that the use of copyrighted works without permission of the copyright owner is allowed only in accordance with the limited purpose of use. Due to the limitations of this copyright law, although TDM is a necessary act to successfully enter the 4th industrial revolution, and contributes to the public interest, it is subject to legal restriction of copyrights. The legislative attempts to harmonize and balance the development of TDM technology and copyright law have been active in the UK and Japan since 2010. In this paper, we discuss how to tune the relationship between the development of TDM technology and the copyright law, whether there is a need to introduce new copyright restrictions for TDM in the copyright law.
