일본 철도의 외주화와 노동자ㆍ시민 안전
A Study on the Negative Effects of Railroad Outsorcing on Public and Occupational Health and Safety in Japan

본 연구는 일본의 사례를 통해 철도사업 부문 외주화의 문제점을 노동안전 및 시민안전 위협을 중심으로 살펴보고자 한다. 이하에서는 1987년 4월 일본국철 분할민영화를 통해 출범한 일본여객철도의 주요 3사의 사례를 통해 먼저 일본 철도의 외주화 과정 및 현황을 살펴보고, 다음으로 외주화로 인한 위험 증대의 요인들을 불법파견 문제, 고용 및 노동조건 악화, 숙련공백으로 인한 기술력 저하, 대형사고 발생과 같은 안전위협의 증대, 사고대응 부실화 등의 측면에서 살펴본다. 특히 전반적인 안전위협 증대와 관련해서는 외주화로 인해 안전규제라는 사회적 규제가 무력화되고 있다는 점에 주목한다. 특히 대형사고와 관련하여 기존의 주된 사고 원인이 민영화의 정치적 목표였던 노동조합 약화의 직접적인 결과였다면, 최근에 들어서는 외주화의 부정적 측면이 겹쳐져 발생하고 있다. 이전에는 국철이 모두 담당하던 업무를 복수의 외주업체가 작업을 수행하다 사고가 발생하며, 노동안전 역시 마찬가지이다. JR동일본은 잘 정비된 사고예방 시스템을 갖추고 있으나, 본사 직접고용 노동자들에게만 적용된다는 점에서 외주화 자체에 대한 규제의 미진함이 사회적 규제의 무력화를 낳고 있다고 볼 수 있다.
Abstract
This study examines the problems of outsourcing of the railway business sector through the case of Japan, focusing on occupational health and safety and public safety threats. First, the outsourcing process and status of the Japanese railway in the case of the three major Japanese passenger railways were launched through the privatization of the Japanese railway in April 1987. Next, major factors of increased risk from outsourcing are the deterioration of employment and working conditions, the deterioration of technology due to lack of skills, the increase of safety threats such as major accidents, and the inconvenience to other accidents. Particularly, regarding the increase of the overall safety threat, it is noted that the social regulation focused on safety is inactivated due to outsourcing. Especially in the case of major accidents, in the past, a number of subcontractors were involved in the work that the National Railways was responsible for, and accidents occurred. JR East has a well-established accident prevention system, but it can be said that the lack of regulation on the outsourcing itself is leading to the "disabling of social regulations" because it is applied only to direct employment workers in the contractor.
