「노인복지법」상 노인학대에 관한 규정의 개정방안

초록
우리 사회가 고령사회로 진입하게 되면서 노인문제 중에서 노인학대가 심각한 사회문제로 등장하게 되었다. 특히 가정 내 노인학대의 경우는 노인학대행위자가 가족인 경우가 대부분이기 때문에 은폐되는 경우가 많고, 오랫동안 지속적으로 발생하게 된다. 따라서 노인학대의 경우 학대피해노인에게 미치는 부정적 영향이 매우 크고, 심지어 피해노인에게 폭력에 대한 무력감을 키워 학대방지를 위한 국가나 사회의 개입마저 어렵게 하고 있다. 이에 「노인복지법」에서는 2004년 처음 노인학대에 관한 규정을 도입한 이래로 수차례의 개정을 걸쳐 수정·보완하였다. 또한 국가에서도 노인학대 예방 및 보호 등에 대한 대책 등을 수립·시행하는 등 학대의 방지 및 피해노인을 위한 지원체계를 마련하고 있다. 하지만 노인학대는 줄어들지 않고 있으며, 피해노인에 대한 보호가 여전히 미흡하다는 지적이 끊이지 않고 있다. 따라서 「노인복지법」의 전면적인 개정 움직임에 즈음하여 「노인복지법」상 노인학대에 관한 규정의 전면적인 검토 및 수정·보완이 요구된다. 이에 본고에서는 그동안 노인학대에 관련된 필자의 선행연구를 바탕으로 하여 「노인복지법」상 노인학대에 관한 법규정을 개별적으로 분석·검토하는 한편, 수정·보완할 사항을 구체적으로 제시하였다.
Abstract
As our society becomes an aging society due to the increase of older population, an elder abuse has arisen as a serious social problem. Particularly, in the case of elder abuse, because most of batterers of elder abuse are family members, a lot of cases are hidden and occur consistently for a longer period of time. In consequence, in this case, negative impacts to the elder are severe and moreover by growing helplessness to violence to the elder it makes difficult for a state or a society to intervene for the prevention of abuse. Therefore,「Elder Welfare Act」has been revised and supplemented through several amendments since its introduction of articles about elder abuse in 2004. However, the number of elder abuse cases is not decreasing and the criticism stating the protection towards the elder victims is still insufficient remains. Therefore, an overall revision in the regulations of elder abuse in 「Elder Welfare Act」is required with the current flow of the overall revision of the act. In this article, based on the my precedent research about the elder abuse, the provisions about the elder abuse in 「Elder Welfare Act」are individually analyzed and revised and the articles to be revised are concretely suggested.
