보편적 건강보장 관점에서 본 남·북의 의료보장제도 관련 법률 내용 비교
A Comparative study on the contents of laws related to the Health Care System of the South Korea and the North Korea from the perspective of Universal Health Coverage

이 논문은 의료보장제도 내 적용인구의 범위, 적용 서비스의 범위, 재정적 위험의 해결과 같은 보편적 건강보장의 각각의 요소를 통해 남한과 북한의 의료보장제도와 관련한 법률의 내용이 현재의 시점에서 어떠한 차이를 보이고 있는가를 비교·검토하였다. 남한은 「국민건강보험법」과 「의료급여법」을 중심으로 의료보장제도를 시행하고 있다. 보편적 건강보장의 각 요소의 측면에서 보험료장기체납자와 같은 일부의 인구가 문제로 지적되지만 지속적인 ‘보장성 강화정책’과 ‘보험료 경감’ 및 ‘본인부담금 면제’와 같은 제도를 통해 보편적 건강보장의 각 요소의 측면에서 범위를 확대해 나가려는 노력을 기울이고 있다. 북한은 「인민보건법」 및 「의료법」을 통해 ‘완전하고 전반적인 무상치료제’의 개념을 통해 관련 법률을 규정하고 있기 때문에 겉으로는 보편적 건강보장의 각 요소(적용인구의 범위, 적용 서비스의 범위, 재정적 위험의 해결)에 문제를 찾아볼 수 없다. 그러나 1990년 이후 나타난 북한의 경제 위기는 법률 상의 내용과는 무관하게 보편적 건강보장의 각 요소 측면에서 의료보장제도에 대한 북한 주민의 접근을 어렵게 만들었다. 남한과 북한은 서로 다른 사회·정치 체제 내에서 보편적 건강보장의 관점의 의료보장제도의 발전을 위한 방향 역시 서로 상이하다. 남한은 제도 운영 상 나타나는 일부의 소외계층에 대한 문제와 보장범위에 대한 사항을 보장성 강화 정책을 통해 점차 확대해 나가고 있다. 반면 북한은 법률 상 내용과는 무관하게 운영이 어려워진 의료보장제도에 대하여 대도시를 중심으로 다시 회복시키려는 움직임을 보이고 있어 대도시와 지방 간의 격차가 심화될 가능성도 존재한다. 따라서 지속적으로 나타날 수 있는 이러한 의료보장제도 내 남·북의 격차를 줄이기 위해 통일을 준비하는 과정 속에서 보편적 건강보장의 관점에서 남한과 북한의 의료보장제도가 어떠한 방향으로 변화해 가는지 지속적으로 살펴볼 필요가 있다.
Abstract
This paper examines the content of the law on health care systems in South Korea and North Korea through the elements of Universal Health Coverage such as the coverage of the population covered by the health care system, the scope of service covered, and the resolution of financial risks, therefore whether they are showing differences. South Korea implements the "National Health Insurance Act" and the "Medical Care Assistance Act". In terms of each element of Universal Health Coverage, some of the population such as long-term delinquents is pointed out as a problem, but each system of universal health guarantee through the system such as a continuous policy of strengthening protection, insurance premium and out of pocket expense reduction in order to expand the scope of the effort. Since North Korea defines related laws through the concept of "complete and comprehensive free care system" through the "The Public Health Law" and the "Medical Service Law", each element of Universal Health Coverage (scope of population coverage, scope of service coverage, the solution of the financial risk), could not find any problem. However, since 1990, North Korea's economic crisis has made it difficult for North Korean people to access the health care system in terms of Universal Health Coverage regardless of the legal content. South Korea and North Korea also have different directions for the development of the health care system in terms of the Universal Health Coverage within different social and political systems. South Korea is gradually expanding the problem of some of the underprivileged groups that appear in the system operation and the scope of the coverage through the protection strengthening the policy. On the other hand, there is a possibility that the gap between the metropolitan and provincial regions will deepen as North Korea is trying to restore the health care system, which is difficult to operate regardless of the contents of the law. Therefore, in the process of preparing for unification, it is necessary to continuously review the direction of the health care system of South Korea and North Korea in terms of Universal Health Coverage
