이스라엘의 가자지구 정책에 대한 국제법적 평가

초록
2005년 9월 이스라엘 군병력의 철수를 계기로, 국제사회에서는 가자지구가 여전히 이스라엘의 점령지역이라고 볼 수 있는지, 이스라엘과 가자지구 사이에 어떠한 법체계가 적용되는지 등과 같은 가자지구의 법적 지위에 관한 논란이 발생하기 시작하였다. 가자지구에서의 군병력 철수를 계기로, 이스라엘은 가자지구 주민들에 대한 법적 의무를 부인하거나 그 범위를 감소시키기 위해 끊임없이 노력해 왔다. 표면상으로 이스라엘은 그 정부에게 가자지구 주민들의 “필수적인 인도주의적 요구”를 충족시킬 의무가 존재한다고 하면서도, 가자지구 정책은 사실상 이들이 갖는 일체의 권리를 부인하는 것이었다. 가자지구에서의 철수 이후, 이스라엘은 주민들이 그 생존에 필요한 물자와 장비를 수령하려는 활동과 여타의 정치적･사회적･문화적･경제적 권리를 실현하기 위한 전제가 되는 ‘이동의 자유’를 광범위하게 제한해 왔으며, 가자지구 주민들의 다양한 생활요소에 깊숙이 개입하여 상당한 수준의 지배력을 행사해 왔다. 그럼에도 불구하고 가자지구의 법적 지위에 관하여 이스라엘과 국제사회의 관점 사이에 상당한 간극이 존재하고 있다. 이에 따라 가자지구에 대한 이스라엘의 정책과 그 적법성을 평가하는 기준에 있어서도 논자에 따라 견해가 대립되고 있다. 이스라엘의 가자지구 정책이 국제법에 부합하는 것인지를 평가하기 위해서는 먼저 가자지구가 여전히 점령지역에 해당하는지, 가자지구에 어떠한 법체계가 적용되어야 하는지에 관한 문제가 명확히 해명되어야 한다. 이에 대한 검토에 기초하여 본 논문은 이스라엘이 가자지구에 대하여 부담하는 국제법적 책임과 의무를 규명해 보고, 가자지구에 대한 정책의 적법성을 평가하였다.
Abstract
Since the withdrawal of Israelis from Gaza in 2005, there have been debates as to whether Gaza is still occupied by Israel and what kind of legal regime can be applied to Gaza. Since the evacuation of military forces from Gaza, Israelis have put efforts in denying or reducing legal obligations towards Gaza inhabitants. In addition, while Israelis have advocated that the Palestinian Authority needs to fulfill ‘essential humanitarian needs’ of Gazans, their policies have denied all of the authorities they have. Moreover, Israelis have restricted the ‘freedom of movement’ that is at the core for obtaining materials for survival and achieving Gazans’ political, social, and economic rights; and control Gazans’ lives deeply in various sectors. Nevertheless, there is a perspective gap between Israel and international society on the legal status of Gaza; thus, there is controversy in evaluating the legality of Israeli policies on Gaza. In order to assess the legality of Israel, one needs to account for whether Gaza is still occupied by Israel and what kind of legal regime can be applied. Therefore, this paper explains the responsibility and accountability of Israel toward Gaza within international law and evaluates the legality of Israeli policies on Gaza.
