「부정청탁 및 금품등 수수의 금지에 관한 법률」에 대한 인식과 효과, 그리고 조직 환경의 조절효과에 관한 연구: 교육행정 공무원을 대상으로

부정부패는 정부에 대한 국민의 신뢰와 국가경쟁력에 큰 영향을 미친다. 이에 정부는 관련 법을 제정 및 시행하는 등 해결을 위한 지속적인 노력을 하여왔다. 특히 2016년 「부정청탁 및 금품등 수수의 금지에 관한 법률」을 시행하여 아래로부터의 변화를 도모하고 있지만 여전히 정부에 대한 국민의 신뢰는 부정적이라고 할 수 있다. 이러한 배경에서 본 연구는 일선교육현장에서 다양한 행정업무를 수행하고 있는 교육공무원을 선정하여 청탁금지법에 대한 인식과 효과(식사, 선물, 경조사비) 간 관계에서 이들이 처한 조직의 환경(조직외부, 내부, 조직문화) 등이 어떠한 조절효과를 미치는지를 분석하였다. 분석결과 청탁금지법 효과에 점검빈도의 교호작용항은 (-)의 영향을, 발전문화의 교호작용항은 (+), 리더의 엄격성 교호작용항은 (+)의 영향을 미치는 것으로 나타났다. 따라서 해당 법률에 대한 인식을 유지 또는 제고 시킬 수 있는 현실적이면서 합리적인 점검 방식과 변화지향적인 문화조성, 그리고 해당 법률에 대한 리더의 인식을 강화할 수 있는 교육 및 인식개선 프로그램 등이 필요하다. 더불어 본 연구는 청탁금지법 효과에 영향을 미치는 조직 환경 요인들을 탐색적으로 연구하였다는 점에 의미를 두고자 한다.
Abstract
The defeat greatly affects the people's trust in the government and national competitiveness. In response, the government implemented the "the Improper Solicitation and Graft Act" in 2016, but public confidence in the government remains negative. Against this backdrop, this study selected education officials who performed various administrative tasks at front-line education sites to analyze the environment of the organization (external, internal, organizational culture) they face in relation to the recognition and effectiveness of anti-graft laws. The analysis shows that the interaction terms of frequency of inspection (-), the interaction terms of the development culture (+), and the leader's rigidity (+) influence the legal effect. Therefore, there is a need for realistic and reasonable inspection methods that can maintain or enhance awareness of the law, ways to create a change-oriented culture, and educational and awareness improvement programs that can enhance the leader's awareness of the law.
