TBT협정과 국제표준의 정의에 대하여 -연혁적 고찰을 중심으로-
TBT Agreement and the Definition of International Standards -Focusing on the Historical Perspective-

초록
국제표준은 비무역장벽에 대한 해결을 위하여 케네디라운드 이후에 그 논의가 활발하게 논의되기 시작하여, 도쿄라운드의 Standards Code에서 지금의 TBT협정과 유사한 모습을 갖추기 시작하였다. 우루과이라운드에 TBT협정과 더불어 SPS협정이 새롭게 만들어지면서, 국제표준을 그 영역을 넓혀 나갔다. WTO협정의 국제표준과 관련된 규정은 비관세장벽 또는 비무역장벽과 관련된 규정에 주로 규정되었고, 그 중에서 TBT협정은 국제표준과 관련된 가장 기본적인 협정으로 볼 수 있다. TBT협정과 관련된 사건 중에서 EC-Sardines 사건과 US-Tuna II (Mexico) 사건은 국제표준의 정의에 대하여 서로 다른 접근을 하고 있다. TBT협정 제2.4조 및 제2.5조의 해석을위해서도 국제표준의 정의에 대하여 명확히 할 필요가 있다. 국제표준이 무엇인지에 대한 본격적인 논의는 1970년 11월을 기점으로 시작되며, 표준(standard)이라는 용어의 정의는 어는 정도 정리가 되어 있는 상황에서, ‘국제’(international)라는 용어의 정의에 관심을 가지기 시작하였다. 표준을 만드는 기관(organizations)의 성격을 통하여 ‘국제’라는 용어의 의미를 파악하고자 하였다. 도쿄라운드에 들어와서는 Draft Code의 국제표준의 정의와 ECE용어의 국제표준의 정의를 어떻게 조화시켜야 할 것인지에 대한 문제가 부상한다. 특히 1975년 9월에 핀란드의 K. Bergholm은 ECE/ISO 정의의 적용가능성에 대하여 조사하여 보고하게 된다. 1976년 11월에 K. Bergholm은 용어의 정의목록에서 삭제가능한 용어에 대하여 언급하면서, 국제표준(international standard), 표준화기구(standardizing body), 국제표준화기구(international standardizing body), 지역표준화기구(regional standardizing body) 등과 같은 용어를 정의에서 삭제할 것을 제안하였다. K. Bergholm의 삭제가능한 용어는 국제표준의 정의가 WTO TBT협정에서 사라지게 되는 단초가 되었다고 볼 수 있을 것이다. 그러나 도쿄라운드 Standard Code에서는 국제표준의 정의삭제라는 K. Bergholm의 주장은 반영되지 않았다. 국제표준의 정의가 삭제되는 것은 우루과이라운드에 들어와서 이며, 기술규정(technical regulation)과 표준(standard)에 대한 용어를 중심으로 정의되게 된다. WTO협정에 들어오고 나서, 특히 TBT협정의 국제표준관련 규정은 표면적으로는 비무역장벽을 장벽을 제거하고 국제무역의 불필요한 장애를 제거하고 무역을 원활화하는 역할을 한다는 점에 대해서는 모든 WTO 회원국들이 동의하고 있으나, 실제로는 국제표준의 사용을 통제하려는 움직임이 더 활발해진 시기라고 볼 수 있을 것이다.
Abstract
To solve the problems of the non-trade barriers, international standards began to be discussed after the Kennedy Round. The contents of international standards began to look similar to the WTO TBT Agreement from the Standards Code of the Tokyo Round. As the SPS Agreement was newly made in the Uruguay Round along with the TBT Agreement, the international standard broadened its scopes and began to be stipulated in GATS, Pre-Shipment Inspection Agreement, and Government Procurement Agreement. The provisions relating to the international standards of the WTO Agreement were mainly stipulated in the provisions relating to non-tariff barriers or non-trade barriers, among which the TBT Agreements can be regarded as the most basic agreements relating to international standards. Among the cases related to the TBT Agreement, the EC-Sardines case and the US-Tuna II (Mexico) case have different approaches to the definition of international standards. For the interpretation of Articles 2.4 and 2.5 of the TBT Agreement, it is also necessary to clarify the definition of the international standard. The discussions regarding the meaning of the international standards were made in November 1970. At that time the definition of the term ‘standard’ was already discussed and began to have interest in the definition of the term ‘international’. Drafters tried to understand the meaning of the term 'international' through the nature of the standards-making organizations. It was the “Rogers draft” of December 1971 that first introduced the definition of international standards. In the Tokyo Round, the question arises as to how to harmonize the definition of international standards in the Draft Code with the definition of international standards in the ECE terminology. In September 1975, K. Bergholm of Finland reported on the applicability of the ECE/ISO definitions. In November 1976, K. Bergolm referred to the terms that can be deleted from the definition lists such as international standards, standardizing bodies, international standardization bodies, and regional standardization bodies, and so on. K. Bergolm argued that terms that can be deleted from the definition lists should be interpreted in accordance with the Vienna Convention on the Law of the Treaties, and that the general meaning of the terms is in most cases the same as the definition of ECE/ISO definitions. K. Bergholm's terms that can be deleted could be seen as the starting point for the definition of international standards to be deleted from the WTO TBT Agreement. However, in the Standards Code of the Tokyo Round, K. Bergholm's argument to delete the definition of international standards was not reflected. The definition of the international standard was deleted in the Uruguay Round. Although all WTO members agree that the provisions relating to international standards in the TBT agreement play a role in removing non-trade barriers, eliminating unnecessary obstacles to international trade and facilitating trade, in practice, it could be seen as a period when movement to control the use of international standards has become more active.
