장애인 소년보호사건 사법지원 방안 연구

Focusing on the fact that legal support and reasonable accommodation are not properly provided to protected juveniles with disabilities in juvenile protection cases, this research summarized the types of legal support and reasonable accommodations that can be provided to the juveniles with disabilities under the current system. The two main issues to be dealt with in this study are as follows: First, what are the characteristics of the disabilities that should be particularly noted in investigation process of juvenile protection cases? Second, are juveniles with disabilities in juvenile protection cases provided with sufficient legal support and reasonable accommodation under the present legal system? The results of the analysis are as follows: First, it is necessary for the juveniles with disabilities in protected juvenile cases to have new investigation and trial system that comprehensively take into account not only the type and characteristics of the disabilities but also the specificity of the legal procedures of juvenile protection cases. Second, the current judicial support system and the reasonable accommodations that are provided to the people with disabilities under the current legal system are not sufficient enough to protect the protected juveniles with disabilities in juvenile protection cases, so that significant improvement is required. Based on the results of this analysis, the researchers of this study present several new suggestions on how to improve the current legal support system for juveniles with disabilities in juvenile protection cases.
