To effectively root out insurance fraud, it is necessary to come up with a thorough and efficient prevention policy through the entire phase of the insurance company's work such as the stage of maintaining contracts and paying insurance money, etc. In the insurance policy phase, it is necessary to block the inflow of potential insurance fraud-causing risk through strengthening underwriting, addressing information asymmetrical problems through sharing information, blocking the inflow of overlapping insurance policies and active sharing of insurance information and medical information. It is also necessary to strengthen the punishment of insurance swindler and strengthen the punishment of insurance fraud conspirators such as maintenance companies and doctors by ㄱㄷrevision of relevant statutes. Our society has been engaged in various activities to prevent insurance fraud and rediscover. Nevertheless, insurance fraud is still rampant and its behavior is only getting dexterous and vicious. Insurance fraud is a very nasty crime that shakes the foundation of the insurance system and thus leads to various violent crimes, disrupting social tranquility and order. Therefore, our society should continue to cope with insurance fraud with all its efforts. In this thesis, I would like to review whether an insurance company can collect evidence on its own, such as through photo and video shoots, in order to effectively investigate and detect suspected insurance frauds through studying the recent court ruling on. I also want to find ways to make up for the problems revealed in the court ruling.
