“UNCITRAL 신원관리 및 신뢰서비스의 국제적 승인에 관한 규정안”에 대한 고찰

초록
최근 인공지능의 발달과 5G 등 통신망의 고도화로 과거보다 더 국제적인 전자거래가 증가될 것으로 예상되지만, 한편으로 국제 전자거래가 폭발적으로 증가하여 국제거래의 일반적·보편적 방식으로 완전히 자리 잡기 위해서는 전자적인 거래방식의 신뢰성과 안전성을 확보하는 것이 불가결한 요소이다. 이처럼 전자적 거래 방식의 안전성과 신뢰성을 확보하여 국제거래를 증진시키기 위한 법적 기초를 논의하기 위하여 유엔 국제상거래법위원회(UNCITRAL)에서는 “신원관리 및 신뢰서비스의 국제적 승인에 관한 규정안(Draft Provisions on the Cross-border Recognition of Identity Management and Trust Services)을 중심으로 구체적인 논의를 진행하고 있다. 신원관리나 신뢰서비스에 대한 논의는 이제 막 본격적인 논의가 시작된 것이지만, UNCITRAL에서의 국제거래규범에 대한 각종 논의는 실제 우리나라를 비롯한 많은 나라에 실질적으로 큰 영향을 주었다. 지금 진행 중인 UNCITRAL의 신원관리 및 신뢰서비스와 관련한 규범 제정 논의도 향후 우리 법제의 정비에 많은 참조가 될 수 있기 때문에 이 글은 규정안의 주요내용을 상세히 소개하고 우리 법제에의 시사점을 제시하였다. 즉, 규정안의 체계와 적용범위, 규정안의 기초가 되는 기본원칙으로서 기능적 등가성, 비차별성, 기술 중립성, 당사자 자치 및 해석원칙을 분석하였다. 신원관리 및 신뢰서비스의 법적 승인과 신뢰성 확보를 위한 규정과 함께 신원관리 시스템 운영자 또는 신뢰서비스 제공자의 의무와 책임을 살펴보았다. 그리고 신원관리 및 신뢰서비스의 국제적 측면의 규율에 대하여 살펴본 후 우리 법제에의 시사점을 제시하였다. UNCITRAL에서의 논의와 같이 국제적인 규범에 의하여 외국의 신원확인 및 신뢰서비스가 승인되도록 하는 체계를 정립하는 것은 국제적인 전자거래의 증진에 많은 도움이 될 것이고, 무역이 경제의 큰 비중을 차지하는 우리나라의 경우에도 긍정적인 영향을 미칠 것이다. 따라서 UNCITRAL의 논의과정에 적극적으로 참여함과 동시에 국제적인 규범 정립의 동향을 면밀히 파악하여 우리 법제를 국제적인 흐름과 보조를 맞추면서도 우리 경제의 발전에 기여할 수 있는 방향으로 정비할 수 있도록 깊이 있는 연구와 논의가 지속되어야 할 것이다.
Abstract
In recent years, the development of artificial intelligence and the advancement of communication networks such as 5G are expected to increase the number of international electronic transactions. However, in order to increase the international electronic transaction explosively, reliability and safety of the electronic transaction system are indispensable factors. In order to discuss the legal basis for securing the safety and reliability of the electronic transaction system and promoting international transactions, UNCITRAL has proposed the “Draft Provisions on the Cross-border Recognition of Identity Management Trust Services”. Discussions on identity management and trust services have just begun, but discussions on international trade norms at UNCITRAL have had a substantial impact on many countries, including Korea. This article introduces major contents of the draft provisions in detail and suggests implications for Korea because the discussions on norms related to the identity management and trust service of UNCITRAL can be a reference for the improvement of our legal system in the future. In other words, this paper analyzed functional equivalence, non-discrimination, technology neutrality, party autonomy and interpretation principles as the basic principles underlying the draft provisions. Also this paper have looked at the scope of the draft provisions, duties and responsibilities of an identity management system operator or trust service provider, together with legal approval of identity management and trust services. Draft provisions on the international aspects of identity management and trust services are also introduced. Establishing a legal system that allows foreign IdM and trust services to be approved by international norms, as discussed in UNCITRAL, will be very helpful in promoting international electronic transactions. Especially in Korea, where trade accounts for a large portion of the economy, it will have a positive impact. Therefore, Korea should actively participate in the discussion process of UNCITRAL and closely study the trend of international norms formation so that we can improve our legal system in a direction to contribute to the development of our economy while keeping pace with international trends.
