비장애 운동선수의 아시안 패러 게임 참가 행위에 대한 법률적 접근과 해석

After the 2018 Jakarta Para Asian Games, a doubtful report of a media, non-disabled participated the game, won medals and received social entitlements like annuity or military exemption, against the national Judo team Korea was released in public. If this report would be proven as real, this is serious crime case for Korean sports for disabled, considering the 2018 Indonesia Asian Para Games is a mega sports events actualize the sports welfare for disabled in the world in maximum and is another opportunity for disabled to live normally as non-disabled. For this research was started with these critical minds. The purpose of this research was to analyze the case upon and interpret it with Korean Criminal Law, Civil Law, other laws and collected research diverse materials. The research was conducted with Content Analysis method and the results were as follows; first, the Korea Paralympic Committee and Korea Judo Federation for Disabled have the rights and responsibility for human resources for the national Judo team Korea as independent special corporation. Second, according to the analysis, the actions like obstructive actions and interferences with deceptive actions in the case became the materials for the sin of fraud. With this reason, sin of fraud on criminal law was established. Last, the Korea Paralympic Committee and Korea Judo Federation for Disabled have the rights to claim for damages against the athletes A, B, C. However, claim for damages against the team leaders is quite limited. Through this study, the rights and obligations of the sports field in Korea based on the possible laws of the Republic of Korea are expected to be defined even more accurately.
