부동산 관련 「특정경제범죄가중처벌 등에 관한 법률」 위반 사기죄에서 이득액 산정의 문제

최근 대법원 판례(대법원 2019. 4. 3. 선고 2018도19772 판결)는 대출금을 상향시킬 목적으로 소위 업계약서를 금융기관에 제출하여 대출을 받은 사건에서 사기로 인한 이득액을 ‘대출금 전부’로 보아 특정경제가중처벌 등에 관한 법률 제3조를 적용하였다. 그러나 사기죄의 보호법익을 전체 재산으로 본다면 ‘재산상 이익’과 표리 관계를 이루는 ‘재산상 손해’는 사기죄의 성립 요건으로 이해되어야 하고 이를 산정함에는 피해자의 객관적⋅개별적 관점이 고려되어야 한다. 이러한 전제에서 본다면 대상 사건에서 발생한 금융기관의 재산상 손해액 및 기망자의 이득액은 대출금 전액이 아닌 초과 대출금액이 되어야할 것이며 결과적으로 특경법이 아닌 형법상 사기죄가 적용되어야 할 것이다. 특경법상 이득액에 의한 법정형 상향의 타당성에 의문이 제기되는 상황에서 일반적으로 거래 가격이 고액인 부동산 거래에 구체적 손해와 이득액의 산정 없이 특경법의 적용을 긍정하는 것은 범죄와 형벌의 비례 원칙을 위반할 위험성이 존재한다.
Abstract
The recent Supreme Court ruling(2018do19772) applied Article 3 of the 「Act on the Aggravated Punishment, etc. of Specific Economic Crimes」, which considers the gain from fraud to be ‘all of the loan’ in the case taking out a loan by submitting a so-called ‘up contract’ to a financial institution for the purpose of raising the loan. However, if the legal interest of fraud is considered as a whole property, the ‘property damages’ should be understood as a requirement of fraud and the calculation of benefit amount in property should take into account the objective and individual viewpoints of the expected act. On this premise, property damages incurred to the financial institution and gains of the accused would have to be ‘the exceeded amount’, not the entire amount of the loan. As a result, fraud will have to be applied to the Criminal Law, not to the special law. In a situation where questions are raised about the validity of aggravated punishment by gains, affirming the application of the special law without the calculation of specific damages and benefits to real estate transactions, which are generally high transaction prices, has the potential to violate the proportionality of crime and punishment.
