정신건강증진 및 정신질환자 복지서비스 지원에 관한 법률에 대한 입법평론 - 강제입원 요건을 중심으로 -

초록
1990년 초 「정신보건법」이 제정되었지만 강제입원에 의한 인권침해가 빈번해지고 정신질환자에 대한 차별적 요소가 존재하고, 복지서비스 지원 근거가 미비하여 법 개정의 필요성이 대두됨에 따라, 2016년 5월 29일 기존 정신보건법의 전면 개정을 통해 「정신건강증진 및 정신질환자 복지서비스 지원에 관한 법률」이 2017년 5월 30일부터 시행되었다. 「정신건강증진 및 정신질환자 복지서비스 지원에 관한 법률」은 정신질환자의 비자의입원 요건을 매우 엄격하게 한 것의 정책적 함의를 인식하는 것도 중요하다. 그러나 법 시행 이후에도 환자가 위기상황에서 적절한 치료를 받지 못하는 상황이 발생하고, 정신질환자 병원 입원에 대한 제도적 허점 때문에 불특정 다수인이 끔찍한 피해를 입는 사건이 벌어지는 등 법의 사각지대가 여전히 존재하고 있다는 지적이 있다. 따라서 정신질환자의 인권과 치료권을 동시에 보장하는 입원절차인 사법입원제도의 전면 도입을 검토하여 법 운영의 실효성을 높이는 방향으로 개정이 필요한 시점이라고 생각된다.
Abstract
「Mental Health Law」 was enacted in early 1990. However, human rights were still violated by compulsory hospitalization, mental patients were still being discriminated, and standards to providing healthcare service were still vague. As direly needed, the original Mental health Law was amended in May 29th, 2016, and 「Mental Health Promotion and Mental Patient Healthcare Service Act」 was executed in May 30th, 2017. 「Mental Health Promotion and Mental Patient Healthcare Service Act」 is important because it fortified regulations of mental patients’ hospitalization against their will. Even after enforcement of the new act, however, blind spots still existed where many patients were not appropriately treated in emergency, and an unspecified number of people were inflicted with terrible harm due to policy loophole of mental patient hospitalization. Therefore, I believe it is time to amend the laws towards enhancing effectiveness of the law enforcement by considering full introduction of Judicial Hospitalization Policy, which guarantees mental patients’ basic human rights and their rights to be medically treated.
