국가연구개발 성과에 대한 지식재산권 모델과 공유 모델의 균형 - 국가연구개발 관리 규정 등 법제도적 측면을 중심으로 -

For decades, the Korean government has been trying to apply the IPR model to the performance management of national R & D projects. Typical examples are the establishment of an evaluation system for the creation of excellent intellectual property, the reorganization of the system related to the attribution of outcomes, the support for facilitating technology transfer and commercialization, and the distribution of technical fees obtained through the use of intellectual property. It is a positive aspect that research results such as securing a large number of intellectual property rights such as patents have been achieved through the application of such intellectual property rights model. On the other hand, it is difficult to deny the negative aspects that the role of the national R & D project, which compensates for market failures, has been ambiguous and the culture of sharing and sharing of research results has been weakened. In order to counteract the negative effects that IPR models can bring, attempts have been made to incorporate shared models such as open source software models and open science models into national R & D projects. In order to support this systematically, work is being carried out such as amending or establishing related regulations. In an attempt to reinforce the role of national R & D projects and maximize their effectiveness, it is necessary to prepare institutional mechanisms for harmonizing IPR models and sharing models. In particular, it is necessary to fully understand the licensing and governance of the sharing model and properly reflect it in the national R & D management regulations.
