Analysis of Characteristics of Housing Lease Dispute Mediation Type

초록

In this study, a two-stage cluster analysis was conducted to analyze the type of mediation for the establishment rate using the mediation data of the housing lease dispute commission, which acts as the regulator in the housing lease dispute. Four types of settlement of housing lease were obtained from the analysis, namely; settlement type, conformity type, competitive type, and avoidance type. The settlement type confirms that the disputes between the Complainant and the Respondent are well resolved through the arbitration process and that it is necessary to identify the factors affecting the establishment of the dispute so as to improve the rate of dispute settlement. The conformity type is where the dispute is amicably resolved between the Complainant and the Respondent. To resolve this type of dispute, it is necessary for the public agency to constantly provide a set of case books, dispute guidelines and legal regulations. The competition type is where the applicant opts for the mediation procedure on the basis that the proceedings are taking place. To resolve this type of disputes, the government is required to operate a fund-supporting system such as inconsistent loans. The avoidance type is the most essential type of dispute resolution in the country. To resolve such a dispute, the establishment of a legal regulation on damages compensation standards, the mandatory repair by the landlord, and a specialized co-ordination team for each division is necessary.
