중국의 지식재산권 침해 화물에 대한 국경조치 연구

Export and import of counterfeits originating from China is continuously expanding around the world. In this regard, China is strengthening crackdown through customs. The purpose of this study is examining which legal actions the Chinese customs is taking with regard to export and import of cargo violating intellectual property rights and looking into the things which Korean intellectual property right holders or government should watch out. For this aim, the contents of the Regulations of the PRC on the Customs Protection of IP Rights have been examined and relevant previous studies have been analyzed. The Chinese customs was actively protecting the rights of intellectual property right holders by inspecting cargo which is likely to violate intellectual property rights. Therefore, Korean firms and government, which possess intellectual property rights, should pay attention to the following. First, intellectual property right holder should receive protection provided by customs by actively registering one's right at the Chinese customs. Second, intellectual property right holder should utilize General Security on the level of securing one's right and the government needs to arrange measures to assist utilization. Third, since the procedure of registering intellectual property right is done in a digital way at the Chinese customs and expenses have been abolished, promotion of this fact and actively encouraging right holders to register their intellectual property right are necessary.
