초록

2003년 5월 21일 성립된 WHO의 담배규제 기본협약(FCTC)은 회원국으로 하여금 담배와 관련된 패키징과 라벨링에 의해 담배의 매력도를 높이지 못하도록 하고 있다(협약 제11조). 이 규정에 근거하고, 2008년 개최된 FCTC 당사국총회에 의해 채택된 이른바 담배의 포장단순화 가이드라인(Tobacco Plain Packaging Guideline)은 회원국들의 컨센서스를 통해 받아들여졌다. 이 가이드라인에 따라 몇몇 국가들은 포장단순화를 통한 금연정책에 동참하게 되었고, 호주가 그 선두에 서게 되었다. 담배회사들과 그들의 조력을 받은 담배 생산국들이 국내적 차원을 넘어 국제적 차원에서 문제를 제기하기 시작했고, 여기서 다루고자 하는 WTO에서의 분쟁해결 절차 역시 이들 중 일부라고 할 수 있다. 인도네시아, 도미니카 공화국, 쿠바 및 온두라스가 제소국으로서 제기한 동 WTO 분쟁해결 절차는 결론에 이르기까지 6년이 넘는 긴 기간을 필요로 했다. 결국 호주가 일단 승소함에 따라 더 많은 국가들에서 유사한 제도가 채택될 것으로 보인다. 이 논문은 WTO에서의 분쟁해결 과정에서 쟁점으로 제기된 TRIPS 및 그 제2.1조에 의해 TRIPS 중 일부로 편입된 파리협약의 개별 규정을, 패널의 평결순서에 따라 분석하기 위한 것이다. 우선 쟁점이 된 규정이 만들어지게 된 취지와 내용에 관하여 보고, 분쟁해결 중에 제기된 쟁점과 패널의 판단에서 발견되는 논증에 대해 살펴볼 것이다. 이어서 제기된 주장들과 패널의 판단에 대해 나름의 평가를 시도해보고자 한다. 무엇보다 TRIPS 제20조는 국가의 규제조치가 상표의 사용을 억제하는 것을 정당화할 수 있는지 판단하는 기준 내지 지침이 되므로, 패널이 원용한 분석방법에 대해 자세하게 설펴보고, 그것이 가지는 의의에 대해 주목하면서 나름의 평가를 해보도록 하겠다. 이 사건에 대한 패널 보고서는 TRIPS와 관련된 기존 보고서들과 같은 선상에 있다고 볼 수도 있지만, 가치판단을 시도하고, 가치 사이의 균형을 추구했다는 점에서는 새롭고 진일보한 모습을 보여주고 있다. 이 논문의 말미에서는 동 보고서의 전반적인 의의와 향후의 유사한 분쟁에 대해 주는 시사점에 대해 생각해보도록 하겠다.

Abstract

The WHO’s Framework Convention on Tobacco Control (FCTC), established on May 21, 2003, obliges its Member States to prevent increasing the attractiveness of tobacco products by strategic packaging and labeling by the tobacco companies (Article 11 of the Convention). Based on this rule, the so-called Tobacco Plain Packaging Guidelines, dealt with in the frame of the Conference of the Parties (COP) to the FCTC held in 2008, were decided by the consensus among the Member States. After the Guideline was adopted, several Member States have begun to implement it and been introducing the plain packaging regulations in their tobacco control programs, with Australia at the forefront. Against this backdrop, tobacco companies and tobacco producing countries have initiated to raise various claims at an international level beyond the domestic and transnational lawsuits. The dispute settlement procedure before the WTO Panel, which is addressed as a main topic in this article, is also one of their attempts to challenge the new regulations. The dispute settlement in question, brought by Indonesia, the Dominican Republic, Cuba and Honduras as complaints, took more than five years to conclude. Although Australia won the case at the first stage, thus a similar regulation will likely be adopted in more countries, the case should be analyzed and evaluated especially with regards to its meaning for the future disputes. This paper analyzes, article by article, the TRIPS Agreement as well as the Paris Convention, which is according to Art. 2.1 TRIPS incorporated as an integral part of the Agreement, raised as issues in the dispute. First of all, it examines the object and content of the individual provisions, with which the Australian regulations in question were confronted, and then it reviews the argumentation contended by the parties towards issues and the findings of the Panel described in the Report. Then, it adds the Author’s own assessment along with the Panel’s path of analysis. Especially, Art. 20 TRIPS leaves the opportunity the room for justifying the restriction on the use of trademarks by the government, which this article examines more extensively focusing on the logical steps towards the justification presented by the Panel and evaluates its significance. The Panel Report overall may be considered as in the same line as dictionary oriented approaches which the previous GATT/WTO reports have tended to maintain, also when interpreting the TRIPS, but it is a step forward in its pursuit of a balance between countervailing values and objectives including somewhat external ones. At the end of the article is addressed the overall significance of the Report and its implications for the future.
