법률가의 노동과 로스쿨 개혁

이 글은 대한민국에서 로스쿨 체제가 출범한 지 10년을 넘긴 시점에서 로스쿨 개혁 의 방향을 일반 시민의 관점으로부터 다시 생각해 보려는 시도다. 나는 법률가도 노동 자라는 당연한 명제에서 출발해 법률가의 노동과정을 분석함으로써 논의의 실마리를 찾고자 한다. 법률가의 노동은 의뢰인의 말, 의뢰인의 글, 법률가의 글, 법률가의 말이 라는네단계를연속해진행된다. 이과정에서뒤단계로갈수록노동의부담은적어지 고 책임은 커지며 더 많은 직업적 이익을 향유할 수 있도록 구조화되는 경향과 함께 이 를 거슬러 뒤 단계의 노동을 앞 단계에서 실현함으로써 직업적 이익을 극대화하려는 경 향에 노출된다. 법률가의 노동과정을 합리적으로 체계화하려면, 이와 같은 두 가지 경 향을 어떻게 해서든 조정·통제하는 시스템을 만들어내야 하며, 이것은 법률가 정치의 가장 중요한 과제이기도 하다. 한국 사회에 진행되고 있는 로스쿨 개혁은 법률가양성과 정에 사법관료주의 대신 사법전문주의를 도입함으로써 법률가의 노동과정을 합리적으 로 체계화하려는 법률가 정치의 새로운 기획이다. 나는 법률가의 노동과정에 대한 분석 에 기초해 로스쿨 개혁이 무엇을 어떻게 바꾸려는 기획인지를 확인한 뒤, 그것이 어디 에서 가로막혀 있는지를 검토함으로써 시민을 위한 로스쿨 개혁의 방향을 탐색한다. 나 아가 최근 부각되고 있는 사법행정위원회를 중심으로 사법개혁에 관련된 헌법 개정 과 제들을 제시함으로써 로스쿨 개혁의 효과를 극대화하는 데 기여하고자 한다.
Abstract
This article is an attempt to think about the direction of law school reform in Korea after 10 years later since its beginning from the viewpoint of ordinary citizen. I would like to start with an affirmation that lawyers are laborers and to try an analysis upon the process of lawyer’s labor. Lawyer’s labor proceeds with four different steps; word of client, writing of client, writing of lawyer, word of lawyer. In this process, lawyer’s labor tends to be institutionalized that the lawyer who charges the posterior steps can enjoy less labor but take more responsibility and occupational interest. However, individual lawyer is exposed to a kind of temptation to maximize his own occupational interest by providing his labor for earlier steps. In order to systemize the lawyer’s labor process reasonably, we have to make a system to harmonize those two contradicting tendencies. This must be one of the major issues for lawyer’s politics in any judicial system. The law school reform in Korea is a new project of lawyer’s politics to systemize lawyer’s labor process reasonably by replacing judicial bureaucratism in legal education and lawyer licensing system drastically with judicial professionalism. After checking the significant aspects of law school reform in Korea, I pursue its new direction by examining the main obstacles of current situation. Moreover, I would like to contribute to maximize the effect of law school reform with a kind of proposal for constitutional revision in the field of judicial reform such as the idea of judicial administration committee, which has been emerged quite recently in Korea.
