미국 로스쿨의 다양성 및 공공성 증진 프로그램- 학생선발, 장학금 및 교육지원 제도에 대한 미국의 경험적 연구결과와 그 시사점-

This study reviews empirical studies on various programs to enhance the diversity and public-mindness of the student body at U.S. law schools. Specifically, it investigates student selection, scholarship and academic support programs in three stages; (1) entry into law school, (2) during law school education, (3) exit to legal market. At the entry level, law schools utilize strong subjective indices to enhance diversity, due to negative and exclusive effects on colored and minority applicants when they overly rely on LSAT scores and undergraduate grade point average. Several scholarship programs to promote public-mindness are actively utilized, including loan repayment assistance program, public interest scholarship, and moral obligation scholarship. At law school classrooms, Socratic method is a dominant educational method. However, it conveys mainstream perspectives, thus systematically restricts diverse viewpoints and experiences of minority students. In order to help these students to adjust and to develop autonomy, various academic support programs are operating. For enhancing diversity and public-mindness at the exit level, practical skill development programs, e.g., legal clinic, externship, field placement, have been most effective.
