이스라엘 국경장벽 설치에 대한 국제법적 검토: 가자지구를 중심으로

초록
이스라엘은 이스라엘과 가자지구 경계지역에 콘크리트 장벽을 설치할 계획을 발표하였는데, 이는 이스라엘의 봉쇄로 인해 고통 받고 있는 가자주민들을 생각했을 때 가혹한 처사라 할 수 있다. 이스라엘은 1967년 제3차 아랍-이스라엘 전쟁 이후 가자지구를 점령하였는데, UN이 가자는 팔레스타인인의 영토이며, 이스라엘은 팔레스타인인에게 해당 영토를 돌려주어야 한다고 촉구했음에도 불구하고 지속적으로 점령상태를 계속하고 있다. 2005년 이스라엘은 가자로부터 전격적으로 철군하였고, 그 이후로는 가자지역에 대한 아무런 법적 책임이 없다고 주장하고 있다. 그러나 2007년 하마스가 가자지구를 집권한 이후부터는 가자 주민들의 이동을 통제하였고, 가자로부터 발진하는 로켓의 공격이나 테러리스트의 공격으로부터 이스라엘을 방어하겠다는 명목 하에 각종 물자의 반입까지 통제하는 등 봉쇄정책을 수행하고 있다. 이러한 봉쇄정책의 수행은 이스라엘이 가자지구를 실효적으로 점령하고 있음을 나타내는 증거이며 이스라엘의 대 가자 정책은 명백한 국제법 위반이다. 또한 국경에 설치되고 있는 장벽은 가자 주민들의 재산권과 자결권을 침해하는 바, 역시 국제법 위반사항이다. 그러므로 이스라엘은 법규 준수는 물론이고 가자에 대한 점령국으로서의 의무를 다해야 할 책임이 있다.
Abstract
Israel has announced that it will construct a concrete wall at the border between Israel and Gaza Strip. Since the 3rd Arab-Israeli War in 1967, Israel has occupied the Gaza Strip despite the United Nations having determined the Gaza Strip as land for Palestinians, and ordered Israel to return the territory to Palestinians. As of 2005, Israel withdrew its military forces from Gaza and has argued it does not have any responsibilities in Gaza. As Hamas seized power over Gaza, Israel began to control the movement of Gazans’ and materials to protect Israelis from rockets and terrorist attacks coming from Gaza. However, according to International Law, Israel has responsibilities over Gaza as an occupying power, and the construction of border wall that infringes on Gazans’ property right and self-determination right is a violation of the International Law.
