전력산업의 변화에 따른 법적 시사점

초록
최근 새로운 에너지기술과 거래모델이 전력산업계에 등장하고 있는데 여기에는 산업패러다임의 전환을 요구할 정도의 혁신적인 내용이 포함되어 있다. 이에 앞으로 발생할 법률문제에 대응하고 제도적 정비를 뒷받침하기 위해 전력산업의 변화에 따른 시사점을 검토하고자 한다. 지금까지는 전력거래에 참여하는 당사자가 제한되어 있고 완성도 높은 시스템 내에서 거래가 이루어졌기에 상거래법적 이슈가 발생한 여지가 많지 않았으나 다양한 거래주체들이 등장하고 거래방식도 다변화되면서 새로운 이슈들이 발생할 것으로 예상된다. 예를 들어 에너지저장시스템이 발전 및 보급되면 이행과정 내지는 이행방식으로 저장단계가 추가되면서 전력저장 후 방전이 지연되는 경우에는 이행지체가 문제될 수 있고 전력저장 후 방전이 준비되어 있는 상황에서 소비자의 수급설비에 문제가 발생한다면 채권자지체에 빠질 수도 있다. 나아가 저장된 전기가 누구의 소유인지 그리고 위험부담의 문제도 함께 고민해야 할 대상이다. 또한 에너지 프로슈머 거래와 같은 새로운 거래플랫폼의 운영 과정에서는 중개사업자, 관리사업자 등과 같은 거래주체가 등장하면서 기존에 없었던 법률관계도 형성될 것이다. 앞으로 전력산업의 변화는 더욱 본격적으로 전개될 것이다. 변화의 크기와 빠르기에 비례하여 다양하고 복잡한 이슈들이 새롭게 발생할 것으로 예상되므로 전력거래와 관련된 변화를 주지할 필요가 있다. 이와 같은 변화의 흐름을 효과적으로 수용하기 위해서는 회사법, 경쟁법 등 다양한 측면의 논의가 필요하며 도소매업자, 중개사업자 등 전력거래 중간상인에 대한 검토가 이루어져야 하고 무엇보다 전력기술에 대한 깊이 있는 이해가 선행될 필요가 있다.
Abstract
Recently, new energy technologies and trading models are appearing in the power industry, which include innovative contents requiring a shift in the industrial paradigm. To prepare for legal problems and institutional improvement, the legal implications arising from changes in the electric power industry should be clarified. Until now, since parties participating in electricity trading are limited and transactions have been conducted under a high-fidelity system, there was little room for commercial legal issues. But now, if the energy storage system is developed, delay of performance could be an issue as the storage step is added to the implementation process or implementation method. In addition, ownership of electricity and allocation of risk are also to be considered. As trading entities such as intermediaries appear, new legal relations will be formed. In the future, environmental changes in the power industry are expected to become more intensifying. As various and complex issues are expected to arise along with these changes, it is necessary to be aware of the changes related to electricity trading. In order to effectively respond to these changes, various studies are required, and examination of intermediaries such as retailer or aggregator should be conducted. Above all, understanding of power technology needs to be preceded.
