초록
한국법정책학회의 역사가 20년이 되었다. 본 논문은 한국법정책학회의 20년의 역사를 주로 한국법정책학회 회장의 의지가 학회운영에 실제로 미치는 영향을 감안하여 학회지의 회장의 발간사를 중심으로 살펴보았다. 한국법정책학회는 주로 해석법학 위주의 우리나라의 법학분야에 법정책학이라는 실용적인 학문을 본격적으로 도입하여 이의 발전을 위해 노력해왔다. 국민의 삶의 질을 높이기 위해 국가의 역할이 커지는 현대 보건복지행정국가에 있어 제도적 정비를 위한 관련 법규의 제･개정 등 법정책학의 중요성은 점점 커질 것이다. 우리나라에서 필요로 되는 법정책학의 발전을 위한 지난 20년간의 한국법정책학회의 노력은 충분히 인정할만한 가치가 있을 것이다. 다만 그동안의 공적은 인정하되 앞으로의 새로운 역사를 통해서는 좀 더 조직적이고 체계적인 노력을 통해 명실상부하게 한국의 법정책학의 깊이 있는 발전이 요구된다. 그 구체적인 내용들이 잘 다듬어져야 할 것이다. 첫째 기존의 다양한 정책분야에 대한 법정책학적 분석을 중심으로 하는 우수한 논문의 지속적인 발표와 검토가 필요하다. 둘째 법정책학의 학문적 검토가 더욱 깊이 있게 이루어져야 한다. 법정책학의 이념적 가치의 정립과 이의 적용, 개별 정책영역에 대해 실제로 적용이 가능한 법정책의 수립, 오늘날 정책의 다학제적･융복합적 성격을 반영한 현실적인 접근, 해당 법정책에 부합된 적절한 방법론의 개발 등 다양하고 입체적인 접근노력이 필요하다. 셋째 개별 법정책에 대한 선험국 등을 대상으로 한 비교법적 검토가 지속적으로 이루어져야 한다.
Abstract
The Korean Association of Law and Politics has been in existence for 20 years. Because the will of an academic society’s president has been influential in the operation of it, this thesis looks around the preface of academic journal for the 20 years history of The Korean Association of Law and Politics. The Korean Association of Law and Politics has been introducing a practical learning of science in earnest development efforts for Korean Law which has been fundamentally devoted to traditional jurisprudence-interpretation of law meanwhile. Because the role of nation is important for the escalation of the quality of people life in modern health–welfare administrative nation era, the importance of politics of law-enactment and revision of law etc for Institutional arrangements has been growing. We should praise the past 20 years efforts of this academic society for the development of Korean politics of law. It is necessary promising Korean politics of law through organized and systematic efforts. We should set up a specific action plan. First, Because the history of Korean politics of law is still short, much more effort is required. We should deeply understand the knowledge of the social science in thinking that the politics of law lies in the social sciences rather than in the legal science. Second, Scholarly review of Korean politics of law should be made more deeply. Diverse and three-dimensional approach-establishment and its application of ideological value of Korean politics of law, practically applicable establishment of politics of law for individual policy, practical approach according to multi-disciplinary and amalgamative nature of politics of law etc is demanded. Third, Comparative politics of law with a country to experience first is demanded consistently.
