정과체육 안전사고의 판례 동향 및 법적 분석과 해석
A Study on Tendency, Legal Analysis and Interpretation of Judicial Precedents involving Safety Accidents during Physical Education Classes

초록
본 연구는 문헌연구를 활용하여 학교 체육시간 중 발생한 안전사고 판례를 분석하고 관련법에 의거하여 법적 해석을 시도하였다. 정과체육 수업 시 발생한 안전사고 관련 판례와 그 동향을 분석하면서 다음과 같은 법적 해석 및 결론을 얻을수 있었다. 첫째, 학생의 선택과 자율성을 보장하고 있는 제7차 교육과정이 그들의 권리의식을 고취하여 법적 분쟁까지이르는 사례 자체는 늘어난 것으로 평가할 수 있다. 둘째, 2007년 학교안전법의 제정으로 학교안전사고로 인한 분쟁을 신속하고 통일적으로 해결할 수 있게 되었다. 셋째, 체육교사는 수업 현장에서 안전사고에 대하여 학생들에게 인식시켜 주어야 한다. 사고 발생 시에도 원인 및 학생들의 부상정도 등의 정황을 파악하여, 교사 및 학교 측은 현실적이고 신속한 사후조치와 대처를 하여야 한다. 넷째, 학생 스스로도 자신의 건강상태, 운동능력 등을 고려하여 안전사고 발생을 방지하고손해가 확대되는 것을 막아야 한다. 마지막으로 체육수업의 선택이 제한되지 않고 전인교육이 활성화 되도록 안전사고관련 제도개선 및 법적정비가 필요하다.
Abstract
The following legal interpretations and conclusions were obtained by analyzing the cases related to safety accidents that occurred during physical education class in schools. first, the 7th Educational Program has led to more legal disputes by promoting a sense of rights among students and their parents. Second, the enactment of the School Safety Act in 2007 enabled quick and unified resolution of disputes caused by school accidents. Third, physical education teachers should inform students about safety accidents in the classroom. In the event of an accident, teachers and schools should take realistic and swift follow-up measures and cope with the situation of the cause and the degree of injury to students. Fourth, students themselves should prevent safety accidents and prevent the widening of damages by taking into account their health conditions and athletic abilities. Finally, the system related to safety accidents and legal maintenance are needed for the revitalization and normalization of physical education.
