토착민족 및 지역공동체(IPLC)의 전통지식 권리 보호와 강화를 위한 국제적 합의 내용 및 주요 쟁점

Until now, Korea has had to be indifferent to international discussions and agreements on the protection and enhancement of rights on Traditional Knowledge of IPLC because there is no IPLC in Korea. But the problem is that Korea is neighbors to China, one of the countries with the richest traditional knowledge in the world. China has already protected traditional knowledge of traditional Chinese medicine, which is the most economically valuable, through domestic law. Therefore, international consensus on the protection and enhancement of the rights on traditional knowledge of IPLC may affect the utilization of traditional knowledge shared by Korea and China. Therefore, it is necessary to pay attention to the international discussion of traditional knowledge. For this purpose, this article is going to take a step further in the existing research and analyzing the WIPO IGC's negotiation text for the traditional knowledge that has been adopted at the COP and the WIPO IGC's negotiation text for the traditional knowledge, and it will look closely at what the issue is. Especially this paper will examine in detail the legal meaning of the main contents and issues Akwé:Kon Guidelines, Tkarihwaié:ri Code of Ethical Conduct, Mo’otz kuxtal voluntary guidelines, Rutzolijirisaxik Voluntary Guidelines.
