대한민국 임시정부 법적지위 판단기준의 문제

초록
본고에서는 대한민국 임시정부의 법적지위를 판단하는 기준에 문제가 있다는 점을 지 적한다. 기존의 접근방법은 당시 국제사회에 임시정부의 법적지위를 판단하기 위한 국제 법이 확립되어 있었다는 것을 전제로 하여 논의를 진행하는 경우가 대다수이다. 그러나 당시 대한민국 임시정부의 법적지위를 판단할 법적 근거가 부족하다. 첫째, 당시 임시정부 또는 망명정부와 관련된 조약과 관습법을 찾기 어렵다. 둘째, 과거와 달리 20세기 초 “정 부”를 중요시하여, 이를 국가의 성립요건 중 하나로 보았는데, 이는 문명기준과 무관하지 않다. 셋째, 당시 망명정부로 승인 받은 사례들도 법리적으로 문제가 많았다. 넷째, 19세기 말 20세기 초에는 제대로 정립된 법리는 단지 국가승인법리뿐이었다. 그러나 이 또한 문제 가 없지 않았다. 다섯째, 대한민국 임시정부를 포함하여 에티오피아와 같이 적국의 전쟁 참전으로 인하여 견해가 자의적으로 급격하게 변하는 경우가 있었다. 이런 사안들을 종합 적으로 보았을 때, 대한민국 임시정부의 법적지위를 판단할 기준이 있었다고 보기 어렵다.
Abstract
This study attempts to point out that there were issues on the criteria of the legal status of the Provisional Government of the Republic of Korea. Most previous studies develop their argument based on the assumption that there were indeed an established criteria or standard to recognize and identify provisional government during World War II or before. However, a careful study manifests that such assumption is groundless. First, treaty or customary law respective to provisional government or government in exile is difficult to be found. Second, the importance of government only emerged in the early 20th century, and it seems it is related to the standard of civilization. Third, state practices in regard to the recognition of the government in exile were problematic in terms of law. Fourth, jurisprudence respective to provisional government or government in exile is difficult to be identified, and the only established rule of law was the recognition of state. Fifth, the practices of some recognition changed rapidly due to the political and military reason. In sum, it is difficult to conclude that there were established criteria or standards to recognize and identify the Provisional Government of the Republic of Korea.
