대학생 욕설사용 양상과 법률 저촉 인식에 관한 연구

이 논문은 사회통념상 욕설은 대체로 모욕으로 인정된다는 법률 해석의 연계선상에서 대학생 욕설사용 실태를 바탕으로 대학생들의 욕설 사용에 따른 법률저촉 인식을 살폈다. 먼저 대학생들이 일상 언어생활에서 사용하는 욕설은 어떤 것들이 있는지 그 유형을 조사한 후, 최근 명예훼손 및 모욕죄 관련 해당 욕설과 비교하여 위법성이 도출될 가능성이 있는 것들을 찾았다. 이는 욕설이 법률적으로 명예훼손이나 모욕죄의 해석ㆍ적용을 통하여 위법성이 있는 욕설로써 유형화된 기준이 명확히 제시되어 있지 않기 때문에 반드시 주시해야 할 부분이다. 그런 후, ‘대학생 욕설사용 양상과 법률저촉 인식 조사’의 설문지로 구성하여 그 욕설에 대해 자신들의 법의식으로 법적평가를 하게 하였다. 이 과정을 통해 대학생들은 욕설사용이 상황에 따라 범죄행위가 된다는 걸 알고 있으나 이에 대한 법의식이 제대로 내면화되지 못했음이 나타났다. 한편 대학생들의 법의식 판단에 의한 위법 해당 가능성에 있는 욕설 언표와 판례를 통해 도출된 모욕죄 해당 욕설과는 차이를 보였다. 현재 대학생들이 쓰고 있는 욕설이 더 모욕적이라는 반응이었다. 대학생들의 법 감정과 법원 법리 적용과의 간극이 나타나기도 하였다. 대학생들의 욕설사용에 대한 언어 순화와 계도 방안으로 인성교육, 법 교육 등 기타 학제간의 통섭교육으로 방향을 도모할 필요성을 피력하였으나, 무엇보다 본 연구는 대학생들이 일반적으로 사용하는 욕설에 자신들의 법의식으로 법적 평가를 내려 보게 함으로써, 욕설유형별 위법 가능성을 인식하고 경계하며 사용을 자제하도록 유도하는 데 목적이 있었다.
Abstract
On the basis of the actual use of profanity by college students, this study analyzed students’ perception of violation of law for the use of such language in light of the legal interpretation that swear words are generally considered to be socially offensive. First, the types of verbal abuse used by college students in their daily lives were surveyed. Then, these were compared with a recent legal case over libel and contempt. This is something that must be monitored because there is no clear standard as to what constitutes illegal abusive language and can be interpreted as a defamation or insult. The questionnaire that we used was “A survey on the use of profanity by college students and an investigation of the perception of law violation”. Through this process, we found that the use of profanity is regarded as a criminal act depending on the situation, but legal consciousness has not been properly internalized. There was a difference between the profane language used by college students and profanity derived from the legal case. It was judged that profanity used by college students is more offensive. There were gaps between how college students feel about the law and the application of court law. As a means of purifying language and teaching methods regarding the use of profanity, it is necessary to promote interdisciplinary education, such as personality education and awareness of law. Most of all, however, the purpose of this study was to encourage students to recognize, be wary of, and refrain from using commonly used swear words.
