The interim legislature of the Korean Provisional Government during the Shanghai period existed as a core institution, and played a key role in the transition from the Korean Empire to the Republic of Korea by enacting the Constitution and establishing a government. Under the Constitution, the Provisional Assembly was a legislative body and the source of legitimacy. It had many powers, including the right to make up the provisional government, which is the executive branch, the right to amend constitutional law and vote on legislation. However, due to the weaknesses of the Provisional Government itself and the difficulty of recruiting members, the provisional assembly was not easy to convene for a long time, and the provisional assembly did not play an active role as a whole. Basically, since the provisional government of Korea was an interim government in an emergency period as an independence movement institution, the actual power was concentrated on the executive branch, and the power of the legislation and control of the government were not properly performed. In addition, as a government located abroad, it was difficult to solve the problem of over-representation by independence activists, especially limited personnel centered in Shanghai, in electing members.
