토지이용에 있어 공중권에 관한 법적 고찰

초록
국가는 국토의 이용 및 관리에 있어 개발의 균형성, 지속가능성, 공공성, 편의성, 환경보호성, 자원 활용의 효율성 등을 고려한 계획을 수립하여 수행할 의무를 부담하고 있기 때문에 이러한 목적을 달성하기 위해 다양한 계획을 수립하고 있다. 최근 이슈가 되고 있는 서울시의 ‘북부간선도로 입체화 사업’이나 서울시의 강남북균형발전의 핵심사업인 ‘강북횡단 경전철 사업’ 그리고 지난 10월 30일 국토교통부가 공식 선포한 ‘광역교통비전 2030’ 등 위의 법률에서 목표로 하고 있는 모두 국민생활에 필요한 토지의 효율적 이용과 공급, 지역 간 균형발전, 생활환경 개선을 위한 국민 삶의 질 향상 등을 위한 계획이라 할 것이다. 여기서 국토의 이용 및 관리 측면에서 이러한 계획들이 가지는 공통점을 찾을 수 있는데, 바로 ‘국토의 입체적 이용’이다. 토지는 한정된 자원으로 특히 우리나라와 같이 면적이 좁은 국가에서는 이러한 입체적인 국토의 이용이 매우 중요하다 할 것인데, 이러한 계획 모두 도심의 지하공간이나 공중공간을 입체적으로 이용하기 때문에 가능한 계획이다. 더욱이 최근에는 제4차 산업과 관련하여 드론과 같은 새로운 비행장치가 등장함에 따라 국토의 입체적 이용에 있어 지표와 분리된 공간의 이용까지도 고려해야 하는 상황이라 할 것이다. 이에 본 연구에서는 지하공간을 제외한 토지이용에 있어 공중권에 대한 법적 검토를 통해 공중공간의 새로운 이용주체로서 등장한 드론과 같은 비행장치를 비롯하여 토지의 이용에 있어 공중공간의 이용 관련 쟁점을 검토하고 그 법적 의미를 제시하고자 한다.
Abstract
The State has developed various plans to achieve this objective because it has a duty to carry out and carry out the plans considering the balance of development, sustainability, public nature, convenience, environmental protection and efficiency of resource utilization in the utilization and management of the national territory. The Seoul Metropolitan Government's recently-announced "Northern Road Elevation Project," the city's core project for balanced development of Gangnam and North Gyeongsang Province, and the Land, Infrastructure and Transport Ministry's "Broadway Traffic Vision 2030" announced on October 30 are all aimed at improving the efficiency and supply of land needed for people's lives, balanced development, and quality of life among regions. Here we can find common ground in terms of the use and management of national territory that is the three-dimensional use of national territory. The use of land will be very important, especially in countries with limited resources, such as South Korea, because all of these plans utilize urban underground or air space in three dimensions. Moreover, the recent emergence of new devices such as drones in relation to the fourth industry requires consideration of the use of indicators and separate spaces in the use of the land in three dimensions. Therefore, this study reviews the issues related to the use of the air space in the use of the land, including airborne devices such as drones that use the air space by reviewing the air right in land use.
