재외동포정책과 초국가적 민족의 헌법적 정초

초록
글로벌시대에 들어 많은 나라들이 디아스포라/재외동포를 대상으로 하는 정책을 개발했다. 그러한 정책을 통해 다른 나라에 상주하는 외국인 중 특정 집단에 대해 민족적, 역사적, 문화적 유대를 이유로 다가가고 그들의 삶에 관여하려 한다. 어떤 나라는 디아스포라/재외동포와의 유대를 헌법에 명시하기도 한다. 어떤 나라는 연고 있는 외국인을 우대하고 그들에게 특별한 지위를 부여한다. 이와 같은 디아스포라/재외동포에 대한 인게이지먼트(engagement) 정책은 국가의 인적, 영토적 경계를 넘어, 국민과 구별되는 민족성원을 창출해내는 의미를 가진다. 이 논문은 세계 각국의 헌법을 개관하여, 그와 같은 초국가적 민족을 창출하는 사례들을 찾아낸다. 그러한 사례들은 대부분 유럽에서, 그리고 일부 아시아에서 발견된다. 이어 이 논문은 디아스포라/재외동포에 대한 인게이지먼트가 어떤 양식으로 이루어지는지를 살핀다. 그리고 그러한 양식들에 대한 규범적 평가를 위한 국제법적 원칙과 규칙들을 검토한다. 이 글은 국민의 경계를 넘어 초국가적 민족을 만들어내는 국가들의 전략을 규율하는 효과적인 가이드라인이 불충분하다는 점을 보여준다. 그러나 초국가적 민족만들기 전략이 현시하는 국가와 민족의 분리(decoupling)가 여전히 베스트팔렌 국제질서의 구성원리를 벗어나는 것이 아님을 강조한다.
Abstract
In the interstices of international law, quite a number of states have developed strategies to reach out to and engage with their diasporic populations or ethnonational kin outside of their borders who are not their citizens but citizens of the state in which they habitually reside. Some states even provide for that kind of policy in their constitutions. Some states grant preferential treatment and special rights to “kin-foreigners,” creating “ethnizens.” This article canvasses provisions in national constitutions in Europe and Asia that provide grounds for engaging with the members of the nation outside of the state, analyzes the modes of engagement, mainly ethnizenship practices and various ways to strengthen links with diasporas, and examines the rules of engagement. It shows that international norm has not provided effective guidelines regarding the strategies of transnational nation-building beyond the personal boundaries of the state and concludes that the decoupling the nation from the state registered by the transnational nationhood strategies falls short of constituting a departure from the logic of the Westphalian nation-state.
