플라톤의『법률』에 있어서 야간회의와 법의 지배

세 명의 이방인들인 아테네인, 클레이니아스, 매길로스는 크노소스에서 우연히 만나 제우스동굴까지 가는 길을 함께 걷게 된다. 이 하루의 여정에서 세 명의 노인들은 ‘말의 여정’을 즐긴다. ‘말의 여행’의 최종 목적지는 야간회의이다. 아테네인은 야간회의를 설립하는 것은 상당히 위험한 시도이며, 야간회의가 바르게 설립 되는가 그렇지 않은가의 여부에 따라서 새로운 국가의 수립이 완전한 승리로 혹은 완전한 패배로 귀결될 수 있다고 경고하고 있다. 본 논문은 이렇게 중차대한 위상을 갖은 야간회의라는 목적지를 정확하게 이해하는 것이『법률』의 전반적이고 깊은 이해를 돕는다는 전제 아래, 야간회의를 차선의 국가의 지배원칙인 법의 지배와 연관시켜 해석하는 것을 목표로 한다. 논의의 핵심은 신의 지성(Nous): 우주=법의 지배(Nomos): 국가=인간의 이성(Reason): 영혼이라는 관계식의 의미를 밝히는 데 놓여 있다. 결론으로 야간회의는 이성적 능력을 발전시켜 신의 지성을 탐구하고 이러한 지혜를 법률에 반영시킴으로써 합리적 ‘신정정치’(theocracy)를 구현하는 중요한 역할을 수행한다는 점이 제시된다.
Abstract
Three strangers - a Athenian, Kleinias, and Megillos - meet by chance at Cnossos and walk together to the destination of Zeus's cave. During one day's travel, three old men also enjoy the travel of logos, the final destination of which is the Nocturnal Council(afterward abbreviated as NC). Athenian says that the risk involved in establishing the NC is enormous and unique, and warns that the business of building a new state like Magnesia might result in a total triumph or a total failure depending upon whether the NC is formed rightly or wrongly. This paper aims at interpreting the nature of the NC in relation to the rule of law which is a ruling principle in the second-best state, under the premise that an accurate understanding of the NC sheds light on the deep understanding of the Laws as whole. The essence of my arguments lies in explaining the meaning of the following equation, that is, Nous: Cosmos= Nomos: State=Human Reason: Soul. As a conclusion, it is argued that the NC plays the important role of realizing the rational theocracy by developing human reason to the maximum strength so as to grasp the Nous, and therewith transforming the wisdom about God's Nous into human laws.
