자율주행자동차의 상용화를 위한 법적 개선방안 연구

초록
현행 ‘자율주행자동차 상용화 촉진 및 지원에 관한 법률’은 자율주행자동차의 안전한 운행기반 조성 등을 통해 자율주행자동차의 상용화를 촉진함으로써 국민의 생활환경 개선과 국가경제의 발전에 이바지함을 목적으로 하고 있다. 그런데 자율주행자동차의 상용화에 있어서는 여러가지 문제점이 제기되고 있다. 우선, 정부의 자율주행자동차 정책방향의 소극성과 국민적 수용성 등이 부족하다는 것이다. 그리고 자율주행자동차의 구조적 불비나 결함에 따른 안전성이 문제되고 있다. 또한, 자율주행자동차의 연구개발에 대한 낮은 집약도 문제, 아울러, 자율주행차의 사고발생 시 원인 규명과 책임 부여의 어려움 등이 문제점으로 제기되고 있다. 위와 같은 자율주행자동차 상용화에 따른 문제점에 대하여는 다음과 같은 개선방안이 요구된다. 우선, 자율주행자동차 정책의 강화를 제고하기 위한 법·제도 개선, 첨단 교통인프라 구축, 안전관리체계 확립, 관학 협동을 통한 추진동력 확보와 정책적 지원이 요망된다. 그리고, 자율주행자동차의 상용화를 위해서는 자율주행자동차의 안전기준인 조향장치, 제동장치, 좌석 등의 완비와 충분한 시험운전이 필요하다. 또한, 자율주행차 산업의 경험 및 데이터가 축적과 기술개발을 통한 완전한 상용화를 추구한다. 아울러, 자율주행자동차의 사고 시 신속한 원인규명과 사고책임을 부여하도록 한다. 이러한 개선방안의 구체적 실현을 위해서는 우선 자율주행자동차 정책의 적극적 추진과 정책의 결정에 대한 평가 시스템(피드백)을 통한 발전적 정책집행 및 적극적 지원이 요구된다. 그리고 자율주행자동차의 고도의 안전성 제고를 위해서는 첨단시스템을 도입한 사전점검 및 사후점검을 제도화 한다. 또한 자율주행자동차의 기술 고도화를 통한 자율주행자동차의 완전 상용화와 산업경쟁력 및 국가경쟁력에 기여하도록 한다. 아울러 자율주행자동차의 사고 시 신속한 원인규명과 분명한 책임을 제도화 한다. 결국 자율주행자동차의 상용화와 기술의 고도화를 위해서는 무엇보다도 법적・제도적 보완이 선행되어야 함은 물론이다.
Abstract
‘The Act on the Promotion and Support of Commercialization of Autonomous Vehicles’ aims to improve living environment of people and contribute to the country’s economic development by promoting commercialization of autonomous vehicles through creation of safe operating system of autonomous vehicles, etc. However, there are several problems with such commercialization of autonomous vehicles. First, the government’s policy toward autonomous vehicles is passive and public acceptance is inadequate. And safety according to structural deficiency of an autonomous vehicle is at issue. In addition, difficulties that arise when finding the cause and assigning responsibility in case of an autonomous vehicle accident as well as low intensity in the research and development of autonomous vehicles are being posed. For remedying above problems due to commercialization of autonomous vehicles, it requires to: Improve a law/system for enforcing an autonomous vehicle policy, establish an advanced traffic infrastructure, establish a safety control system, secure the driving force through government-school cooperation and have government’s supporting policy; Complete security devices in an autonomous vehicle such as steering wheel, braking system and seat and have adequate test-driving for commercialization of autonomous vehicles; Pursue full commercialization with extensive experience and accumulated data in the autonomous vehicle industry and technical development, and; Promptly establish the cause and assign responsibility in case of an autonomous vehicle accident. For realizing such improvements specifically, it requires to: Actively promote a policy for autonomous vehicles, and implement and completely support a development policy through an assessment system (feedback) on the decision of policy; Institutionalize pre- and post-inspections with an advanced system so as to increase high-level safety of autonomous vehicles; Pursue full commercialization of autonomous vehicles through advanced techniques and contribute to enhancement of national competitiveness, and; Institutionalize a prompt inquest into cause and transparent responsibility in case of an autonomous vehicle accident. As a result, the legal and institutional complement must take precedence in order for autonomous vehicles to commercialize and have refined techniques.
