미국 환경법 최근 입법 동향

초록
미국은 트럼프 정부 들어 경제발전에 중점을 두고 환경 분야의 규제 완화정책을 펴고 있다. 많은 환경전문가들은 이러한 정책 기조는 전 오바마 정부의 친환경정책에 대한 역행이자 지속가능한 발전을 저해하는 것이라 평가하고 있다. 특히 지구 환경에 심각한 영향을 미치는 기후변화 관련 파리협정 서명 철회 발표와 화석연료 기반 에너지 정책으로 회귀에 일반 시민들조차 우려하고 있다. 나아가 트럼프 정부는 수질보호 관련 연방정부의 권한을 강화하려는 기존정책을 변경함으로서 물 환경보전에 부정적 결과를 초래하고 있으며 멸종위기종 서식지 지정에 있어서도 환경보호라는 정책적 고려 외 경제적 고려를 그 기준에 포함하여 결과적으로 멸종위기종 서식지 지정에 소극적 정책으로 전환하였다. 이외에도 화학물질 규제 관련 기존 독성물질규제법 체제를 근본적으로 변경시킨 2016년 21세기 화학안전법 역시 구체적 이행에 있어서 산업계의 입장이 반영되고 있다는 점 역시 우려의 대상이다. 동 논문은 현재 미국에서 진행 중인 환경규제완화 정책을 분야별로 간략히 검토하여 미국 환경법의 동향을 제시하고 이를 통해 국내 환경정책에 대한 반면교사의 시사점을 얻고자 한다.
Abstract
The election of Donald J. Trump to be the 45th President of the United States understandably horrified environmentalists. During his campaign for the presidency, Trump vowed to not sign the Paris Agreement and abolish administrative regulation regarding environmental protection. After his auguration, major environmental policy regarding climate and energy field had dramatically changed. He called for the EPA. to dismantle the Clean Power Plan in 2017. The planned substitute, the Affordable Clean Energy Rule, is the administration’s most sweeping plan to extend the lives of coal-burning plants and shore up the mining industry an industry more threatened by economic change than regulation. Moreover, Obama government policy on clean water protection was repealed by the new water rule which shrink the federal jurisdiction on the navigable waters. EPA also tries to making regulations and executive order in order to change the direction of the Chemical Safety for the 21st century Act which passed right in Obama government in favor for the chemical industry.
