The faculty is the professional employee under NLRA §152(12), who can form or join labor organizations and choose its representative to bargain collectively about wages, hours and other terms of employment. AAUP, American Association of University Professors, which is founded on 1915, resisted to accept the identification of labor unions for employees at that time. But the economic changes have forced it to be a labor union for the purpose of collective bargaining with colleges and universities. The faculty could not maintain the interest community as a same profession or occupation. The faculty in academic society has been divided as tenure track and non-tenure track faculties and the career movement between them has been exceptional event. The research and education is skills specified for the higher education, that is, they can perform their duty only if they employed in colleges or universities. It has caused the dependency of faculties same as employees in labor law.
