노동법상 근로자 개념과 종속성 판단에 관한 소고 - 학습지교사의 근로자성 판단에 관한 대법원 판결(대법원 2018. 6. 15 선고 2014두12598, 12604(병합) 판결)을 중심으로 -

초록
최근 대법원은 학습지회원에 대한 관리, 모집, 교육을 담당하는 학습지교사에 대하여 근기법상 근로자성은 부정하는 대신, 노조법상 근로자성을 긍정하였다. 이 판결을 통해 근기법상 근로자 개념과 노조법상 근로자 개념의 구별은 보다 명확해졌다. 우선 근기법상 근로자성은, 계약 급부의 목적이 인간의 노동력에 대한 도구적 사용관계일 때 비로소 인정된다. 이른바 인격적 종속관계를 전제로 하여야 한다. 이를 판단함에 있어서는 (i) 인사권 등 회사조직에의 편입 여부와 지시권 행사와 (ii) 경영위험을 스스로 부담하는가 여부가 중요하다. 한편 노조법상 근로자 개념에 있어서는 노무제공 계약관계의당사자 간 경제적 종속관계가 중요하다. 경제적 힘의 비대등성으로 말미암아‘공정’ 거래가 사실상 불가능한 경우, 노조법은 경제적 약자인 노무제공자들에게 단결권을 보장하기 때문이다. 그렇다면 중요한 것은 계약 당사자 간 계약적 대등성 여부를 확인하는 것이다. 학습지교사들의 수입이 특정 회사에전적으로 의존하게 되면서, 계약의 내용이 회사에 의해 일방적으로 정해지는사실에 주목할 수 밖에 없다. 경제적 종속관계 하에서의 위임형 노무제공관계에 대한 노동법 제도체계의 진화를 서두를 필요가 있다.
Abstract
In Korea, there are teachers who teach students privately with their materials. Recently, The Supreme Court recently saw that the teachers could have the right to make Union. But the Supreme Court judged that the contract relationship between teachers and the company was not a working contract relationship. The Supreme Court made clear the distinction between the worker concept in the contract law and the worker concept in the union law. First of all, the contract to provide dependent labor is recognized only when the purpose of contract payment is the instrumental use of human labor. The so-called personal dependency must be premised. Therefore it is important to (i) include the right to exercise one’s right to personnel management and (ii) to bear the risk of management. On the other hand, in the labor law of Union, the economic dependency between the parties in the labor contract is important. If fair trade is virtually impossible due to the inequality of economic power, union law guarantees the right to unite the laborers who are economically weak. It is important to check the contractual equivalence between the parties, rather than the contents of the contract or the facts of the entrusted work. There is also a gray area. Directive and obedience may exist even if they are not related to workers and users under the Labor Standards Act. In some cases, he or she is obedient when the work order is issued among the parties involved in the delegated contract. At this time, the facts of directives and obedience may make it seem like a working-contract relationship exists. However, the facts that appear under economic subordination may seem very similar to the supervisory relations in apparent labor contracts. It should be noted, however, that Economic and personal dependencies should be distinguished. Most importantly, as the mandated labor contracts are expanding. There is a need to urge the evolution of the labor law system for those who are not emplyee but are union workers. The concept of workers varies. As a social underdog, the principle that workers should be protected should be maintained. The important thing is to identify who is socially disadvantaged. This is why legal Regulation for the future labor market seems difficult.
