학교안전사고를 규율하는 특별법에 관한 연구

초록
본고의 제목은 “학교안전사고를 규율하는 특별법에 관한 연구”라고 정하였다. 장래에 어떠한 법적인 문제가 발생할 것인지를 현재의 시점에서 정확하게 예측 내지 예단한다는 것은 사실상 불가능에 가까운 것으로 보아야 한다. 그런데 법 제도라는 것은 정의를 실현할 목적으로 사회질서를 보다 합리적으로 규율하기 위해서 마련된 것이라는 점에서 어떠한 법 제도의 운용과정에서 불합리한 결과가 지속적으로 증가되지 않도록 그 위험성을 최소화할 수 있는 실현 가능한 방안들이 다양한 시각에서 모색되는 것이 필요하다. 이와 관련하여 현재 초등학교, 중학교, 고등학교에 다니는 학생들은 오랜 시간 동안 학교에서 생활하고 있다. 그런데 학생들이 교육활동 등의 학교생활을 하는 과정에서 다양한 원인에 의하여 안전사고가 발생하고 있으며, 이로 인하여 신체적 피해를 입는 경우가 적지 않다. 그리고 학교에서 교육활동 등의 학교생활을 하는 과정에서 발생하고 있는 안전사고의 유형은 매우 다양하다. 예를 들어 수업시간 또는 체육활동을 하는 과정에서 안전사고가 발생하는 경우도 있고, 수업시간 또는 체육활동 이외의 시간동안에도 적지 않은 안전사고가 발생할 개연성이 있다. 그리고 학교에서 발생하는 안전사고로 인하여 학생 등은 정신적 피해는 물론이고, 경우에 따라서는 피해학생 등에게 회복할 수 없는 심각한 신체침해를 입는 경우도 존재한다. 그리고 제주도의 경우에는 다른 지역과 유사하게 초등학교, 중학교, 고등학교에서 안전사고가 발생하고 있지만, 특히 제주도의 초등학교에서 보다 많은 안전사고가 발생하는 것으로 나타났다. 그런데 학교안전사고의 당사자인 학생이나 교사, 학교법인 등에게 책임을 인정하더라도 교사･학생･학부모 간의 윤리적 또는 교육적 차원에서는 여전히 많은 어려움이 있다. 이러한 이유에서 본고에서는 학교에서 발생하고 있는 안전사고를 규율하고 있는 특별법의 내용을 살펴보았고, 당해 특별법의 관련규정 중에서 특히 문제가 될 수 있는 몇 가지 쟁점을 중심으로 적용상 또는 해석상의 문제점과 그 개선방안에 대하여 검토하였다.
Abstract
The title of this thesis is ‘A Study on Special Laws Regulating School Safety Accidents’. It would be difficult at the present moment to predict exactly what problems may arise in the future. However, the legal system is designed to rationalize social order for the purpose of realizing justice. Therefore, the risks should be minimized so that unreasonable results are not continuously increased in the operation of any legal system. It is also necessary that feasible measures be sought from a variety of perspectives so that unreasonable results do not continue to increase. Students in elementary school, middle school, and high school have lived in school for a long time. Students living in school are victims of safety accidents due to a variety of causes. That is, many accidents occur in most schools. Safety accidents occur in various types. For example, a safety accident occurs during class or physical education. In addition, in school, safety accidents may occur in addition to working hours or sports activities. Students are seriously injured due to safety accidents at school. In Jeju, safety accidents occur in middle and high schools, but more accidents occur in elementary schools. A safety-related accident in school occurs inevitably in unforeseeable circumstances while children or students are engaged in educational activities. In addition, even in case a matter of responsibility is clear as majority of the persons directly involved in a safety-related accident in school are minor students or a teacher, or school authorities, such an accident has a characteristic that calling to account is not easy as we usually access the accident from educational dimension. In this paper, we reviewed the contents and major issues of the special law on safety accidents occurring in schools.
