자율주행시스템(ADS)에 대한 안전규제체계 검토 -자동차관리법을 중심으로

Since Automated Driving System(ADS) are a total concept of hardware and software that performs key functions of automated driving vehicles. There is no question that legal definitions and appropriate regulations should be made. In particular, the regulation of vehicles has the characteristics of safety regulations that manage the risks to people's lives and property. Accordingly, laws of each country set up the concept of ADS to link with the definition of automated driving vehicles and further discuss the concept of ADSE or ADP to give the characteristics of the automobile law for ADS and to solve the problem of responsibility for it. As ADS is a key device that performs the "dynamic driving task" of automated driving vehicles in the era of automated driving vehicles, countries' legislative trends that give them a normative nature to do so are reasonable. The concept seems to correspond to the driving of human drivers in the existing legislation. It would also be necessary to establish ADS's guardian and ensure that it has administrative and judicial responsibilities in order to resolve the ADS's attribution of responsibility to it. This paper presents a legislative proposal referring to these international trends. In other words, what we discussed in this paper was the establishment of the relationship between ADS concept and automated driving vehicles, the establishment of safety standards and the establishment of legal grounds for ADS, self-certification of ADS, registration of ADS.
