방송사업자 재허가·재승인 제도 개선 방안

최근 들어 방송사업자에 대한 재허가·재승인 심사가 크게 강화되고 있다. 이를 두고 방송의 공익성·공정성 등을 고려해 바람직하다고 생각하는 긍정적 시각과 방송에 대한 정치적 통제가 강화될 수 있다는 비판적 시각이 동시에 제기되고 있다. 특히 우리 방송이 가지고 있는 정치적 병행성과 오랜 기간 구축되어온 정치권력과의 ‘후견인적 관계’로 인해 자칫 엄격한 재허가·재승인 심사는 방송사들의 ‘자기 검열’을 심화시킬 수 있다는 우려가 큰 것이 사실이다. 더구나 우리 방송법상의 관련 규정과 심의기준들이 매우 포괄적이고 추상적이어서, 재허가·재승인 제도를 강화하게 되면 과잉규제 가능성이 있고, 규제형평성이나 공정성을 침해할 수도 있다. 물론 2000년 이후 여러 차례 재승인·재허가 행위를 통해 제도적으로나 법적으로 개선되어 왔다. 그렇지만 아직도 재승인·재허가 제도가 방송사업자를 실질적으로 규제할 수 있는 정당성을 확보하려면 여러 측면에서 개선될 점이 적지 않다. 특히 정치적으로 오용되는 것을 막기 위해서는 구체적이고 실질적인 심사제도와 기준들이 마련될 필요성이 있다. 아울러 디지털 기술 발달로 다양한 매체들이 등장하는 상황에서 인·허가제도의 본질적 패러다임변화와 적합한 방안들이 모색되어야 할 것이다. 이러한 배경에서 본 연구는 현행 재허가·재승인 제도의 문제점과 개선방안을 모색하였다. 우선 거시적인 관점에서 ‘선별적 진입방식’을 벗어나 ‘원칙허용 진입방식’으로 전환하고, 사실상 형식적일 수밖에 없는 공영방송에 대한 재허가 시스템을 변화시켜야 한다. 미시적 방안으로는 심사기준을 구체화하여 심사투명성을 제고하고 심사위원 선정과정에서 공정성을 강화해야하며 과도한 조건 부여나 기간 단축은 지양해야 할 것이다.
Abstract
Recently, review of renewed license and re-authorization of broadcasters has been greatly strengthened. On this issue, both positive and critical views are being raised. The former is said that it is desirable to consider the public *interest and fairness of broadcasting while the latter is that political control over broadcasting can be strengthened. It is especially true that due to the political parallelism our broadcasting has the long-established "cliental relationship" with political power, strict review of renewed license and re-authorization could deepen the "self-censorship" of broadcasters. Moreover, the relevant regulations and review criteria in the Korean Broadcasting Service Act are so comprehensive and abstract that strengthening the review of renewed license and re-authorization system may lead to over-regulation and may infringe upon regulatory equity or fairness. Of course, it has improved institutionally and legally through review of renewed license and re-authorization activities several times since 2000. Nevertheless, many improvements have been made in many respects to ensure the legitimacy of the renewed license and re-authorization system and to regulate broadcasters effectively. In particular, specific and practical review systems and standards need to be prepared to prevent political misuse. In addition, in the context of emergence of diverse digital media, fundamental paradigm changes in licensing and licensing systems and appropriate measures should be explored. With this background, this study explored the problems of the current renewal permission and re-authorization system and suggested the ways to improve it. First of all, the government should change the ‘acceptance principle approach’ from an analog-type ‘allow selection approach’ in a macro perspective, and change the renewal permission system for public broadcasting, which is a formality virtually. Microscopic measures would require enhancing transparency in review by specifying criteria, enhancing fairness in the selection process of judges, and avoiding excessive conditionality or shortening of duration.
