책임능력의 법적⋅심리학적 판단기준

형법 제10조 제1항에서 말하는 ‘심신장애로 인하여 사물변별능력이나 의사결정능력이 결여된 행위’란 생물학적 측면에서 정신장애(Mental Disorder)가 전제되고 이로 인하여 심리학적 측면에서 위법성인식능력이나 행위통제능력이 상실되어 있는 경우를 말한다. 여기서 정신장애에 대한 판단은 미국정신의학회(American Psychiatry Association / APA)가 제정한 진단기준인 DSM-5(Diagnostic and Statistical Manual of Mental Disorders, Fifth Version)가 사용된다. 생물학적 요소는 의학적 관점에서 진단되는 요소를 의미하는 것이고, 이러한 진단을 임상심리학에서 하고 있으므로 심리학적 판단기준이라고 할 수도 있다. 정신의학이 인간의 심리적인 측면을 연구대상으로 하는 것이기 때문에 생물학적 요소는 정신의학적⋅심리학적 요소라고 할 수 있다. 결국 정신장애 여부와 함께 위법성인식능력이나 행위통제능력이 결여되었는가의 여부에 대한 판단은 심리학적 판단기준을 원용할 수밖에 없어 보인다. 그렇게 한다고 하더라도 이러한 판단은 형법 제10조 제1항 또는 제2항에 해당하는가에 대한 결론을 내리는 것이어서 법해석학의 영역에 속한다. 판례도 이 점을 명확하게 하고 있다. ‘형법 제10조에 규정된 심신장애의 유무 및 정도의 판단은 법률적 판단으로서 반드시 전문감정인의 의견에 기속되어야 하는 것은 아니고, 정신질환의 종류와 정도, 범행의 동기, 경위, 수단과 태양, 범행 전후의 피고인의 행동, 반성의 정도 등 여러 사정을 종합하여 법원이 독자적으로 판단할 수 있다’고 한다. 대법원 1999. 8. 24. 99도1194. 법원이 책임지고 판단하여야 할 사항이기는 하지만 심리학적 판단기준을 잘 활용할수록 바람직하다는 절충이 가능하다. 심신상실⋅심신미약의 생물학적 요소인 정신장애의 인정 여부는 일단 DSM-5에 의존할 수밖에 없다고 생각한다. 정신장애의 핵심 내용은 ‘중대한 정신적 변성(Profound Mental Abnormality)’이다. 책임능력과 관련해서 문제가 될 수 있는 정신장애의 유형을 분류해 보면 다음과 같다. ① 제1 유형 : 병적 정신장애 / 조현병 증상 중 피해형 망상장애② 제2 유형 : 심한 의식장애 / 혼미, 반혼수, 착란, 섬망③ 제3 유형 : 지적장애 / 고도 또는 최고도의 지적장애④ 기타 유형 : 기타 중대한 정신적 변성 / 품행장애 기준 고도의 충동조절 장애이러한 정신장애가 위법성인식능력이나 행위통제능력의 흠결로 연결되었는가에 대한 판단은 유형별로 기준이 달라져야 한다고 본다. 먼저 위법성인식능력의 경우에 대한 판단기준을 정리해 보면 다음과 같다. ① 제1 유형 : 병적 정신장애는 위법성인식능력에 영향을 미치지 아니함② 제2 유형 : 심한 의식장애도 위법성인식능력에 영향을 미치지 아니함③ 제3 유형 : 고도⋅최고도의 지적장애에 해당하면위법성인식능력 없음④ 기타 유형 : 기타 중대한 정신적 변성으로서 고도의 충동조절 장애가 위법성인식능력에 영향을 미치지 아니함이어서 행위통제능력의 경우에 대한 판단기준을 정리하면 다음과 같다. ① 제1 유형 : 피해형 망상장애가 단독으로 행위통제능력에 영향을 미치지 아니함② 제2 유형 : 혼미⋅착란의 경우 행위통제능력 저하됨, 반혼수⋅섬망의 경우에는 행위통제능력 상실됨③ 제3 유형 : 규범의 통제력이 확보되지 않아 행위통제능력에도 결함이 있음④ 기타 유형 : 규범의 통제력이 작동하지 않아 행위통제능력에 결함이 있음
Abstract
The term 'act that lacks discrimination or decision making ability due to Mental Disorder' in Article 10 (1) of the Criminal Code presupposes Mental Disorder from the biological point of view, and therefore, psychologically loses the ability to recognize illegality or control behavior. If it is. Here, the judgment for mental disorders is based on the Diagnostic and Statistical Manual of Mental Disorders, Fifth Version (DSM-5), a diagnostic standard established by the American Psychiatry Association (APA). Biological element refers to an element diagnosed from a medical point of view, and may be referred to as a psychological criterion because such diagnosis is made in clinical psychology. Since psychiatry is to study the psychological aspects of human beings, biological factors can be said to be psychological and psychological factors. As a result, judgment on whether mental disorders and lack of illegality or behavioral control ability seems to use psychological criteria. Even so, it is within the realm of forensic interpretation, as it concludes whether the judgment falls under Article 10 (1) or (2) of the Penal Code. Cases also make this point clear. 'The judgment of the presence and extent of mental and mental disorders under Article 10 of the Criminal Code is a legal judgment, and it is not necessarily bound to the opinion of a professional appraiser. The court can make independent judgments of various circumstances, including the post-war defendant's behavior and the degree of reflection. ' Although the court is responsible and judged, there is a trade-off that the better you use psychological criteria, the better. The recognition of mental disorders, a biological component of mental and mental weakness, is inevitably dependent on DSM-5. The core content of mental disorders is 'Profound Mental Abnormality'. The types of mental disorders that can be a problem in terms of responsibility are as follows. ① Type 1: Morbid delusional disorder among pathological mental disorders / schizophrenia symptoms ② Type 2: Severe Consciousness Disorder / Confusion, Semi-colon, Confusion, Delirium ③ The third type: intellectual disability / high intellectual disability ④ Other types: Other severe mental abnormality / behavioral disorder criteria High impulse control disorder The judgment as to whether such mental disorders are linked to defects in illegal perception or behavioral control should be different for each type. First, the judging criteria for the case of illegal recognition ability are as follows. ① Type 1: Pathological Psychological Disorder Does Not Affect Illegal Recognition Ability ② Type 2: Severe cognitive impairment does not affect illegal perception ③ The third type: Unlawful recognition ability in case of high intellectual disability ④ Other Types: Other serious mental abnormalities, and impulse control impaired by high impulse control. Subsequently, the criteria for the case of behavior control ability are summarized as follows. ① Type I: Damaged delusional disorder does not affect behavior control ability by itself ② Type 2: Deterioration of behavior control ability in case of confusion and confusion. In case of anti-colon and delirium, behavior control ability is lost. ③ Type 3: Defective behavior control ability due to lack of control ④ Other Types: There is a deficiency in the ability to control behavior because the control of the code does not work
