나고야의정서상 유전자원 이용국의 이행법률 분석 및 시사점-유럽연합의 ABS 규칙/시행령/안내서를 중심으로-
Analysis of User Countriy's ABS Acts under Nagoya Protocol and its Lessons to Korea's ABS System

유전자원 이용국을 대표한다고 할 수 있는 유럽연합의 나고야의정서 이행방향은 우리나라나 일본, 스위스, 등 다른 이용국들의 국내 이행방향에 상당한 영향을 미칠 수 있다. 특히 나고야의정서에서 명확하게 규율하지 못한 의정서의 구체적 적용대상뿐만 아니라 시간적 그리고 장소적 적용범위, 유전자원 이용자의 구체적 의무내용, 유전자원이용의 해석, 관련 전통지식의 범위, 불법 취득 유전자원의 범위 및 처리 방법, 유전자원 이용자의 이행준수 확보 방안, 외국 유전자원 이용에 관한 점검기관의 역할 및 기능 그리고 관리방안, 관련 법률 위반에 대한 처벌 범위 및 정도 등에 그 방향을 제시할 수 있다. 유럽연합은 ABS 규칙의 형태로 2014년 EU ABS Regulation을 마련하여 유럽연합에 대해 이행법률을 발효시켰다. 유럽연합은 2015년에는 유전자원 소장기관의 등록, 사용자 이행준수 감시 그리고 모범관행에 관한 세부규칙 확립을 마련하여 중소 규모 바이오기업 이용자들의 행정적 비용과 절차적 부담을 절감하기 위한 제도를 도입하였다. 나아가 2016년에는 유럽연합 ABS 제도를 이용자가 쉽게 이해하고 준수하기 위한 “EU ABS 규칙의 적용범위와 핵심의무에 관한 안내문서를 채택하였다. 이 논문은 나고야의정서에 대한 유럽연합 환경위원회의 ABS규칙(안)과 유럽연합 ABS수정(안)의 비교·분석을 바탕으로 만들어 EU ABS 규칙과 2015 ABS 시행령 그리고 2016 ABS 가이던스를 분석하여 우리나라 나고야의정서 이행법률의 개정과 이행 제고를 위한 시사점을 제시하고자 한다.
Abstract
Representing the user countries of genetic resources and associated traditional knowledge, the European Union's ABS system, including 2014 ABS Regulation, 2015 Commission Implementing Regulation, and 2016 ABS Guidance has provided a significant influences to those of other user counties, including Republic of Korea, Japan, Switzerland, etc. Especially, EU ABS system has steered the course of legislative action in the ambiguous issues, including the material, geographical, and temporal scope of Nagoya Protocol, definition of traditional knowledge associated genetic resources, personal scope, etc. The distinctive features of EU ABS system which can be considered most advantageous to the other user countries would be that it provides the specific obligations with which users of foreign genetic resources and associated traditional knowledge within EU must comply in accordance with the provisions of Nagoya Protocol, so called "due diligence obligation." The ABS Regulation provides also for some additional measures which the Commission must adopt by way of implementing act(s). Subsequently, 2015 Commission Implementing Regulation (EU) was adopted for the register of collections, monitoring user compliance and best practices was adopted. Most recently, despite its non-binding nature, the 2016 ABS Guidance was released to provide information on certain aspects of the relevant EU legislation which can assist citizens, businesses and national authorities in the application of the EU ABS Regulation and the Implementing Regulation. Taking the keen eye on the formulation process of EU's ABS system, the Act and its Decree on Access, Utilization and Benefit-sharing of Genetic Resources of Republic of Korea has followed the EU ABS aspects in many and core obligations under Nagoya Protocol. However, some poor understanding of Nagoya Protocol and EU ABS system has revealed some critical errors and mistakes in the Korea's ABS laws which should be amended in the near future.
