무역환경변화에 따른 관세법 개편방안 연구

본 연구는 우리나라 관세법의 체제를 효율적이고 합리적으로 개편함으로써 행정기관과 국민이 모두 수용가능한 합리적인 분법안을 제안하였다. 선행연구와 주요국(미국, 일본) 사례의 시사점을 근거로 하여 관세법 본연의 목적에 맞는“관세법”안과 관세율 정책과 국경 안전관리 내용을 포함하는“관세정책 및 안전관리에 관한 법”안을 제시하였다. “관세법”안은 총칙, 관세의 부과･징수, 납세자의 권리 및 불복절차, 운송수단, 보세구역, 운송, 통관, 벌칙, 조사와 처분으로 관세법의 기본목적(부과･징수, 통관)에 맞게 개편하는 법안이다. “관세정책 및 안전관리에 관한 법”안은 1) 관세율 정책에 해당하는 과세표준과 과세가격결정방법(재정수입, 통상협력, 국제관례), 품목분류와 관세율(재정수입, 산업보호, 물가안정, 통상협력), 감면세(산업보호, 국제관례) 규정과 2) 안전관리에 해당하는 물류보안 및 국경 안전관리, 특별통관 및 무역원활화, 국제교류 및 협력 증진, 납세편의 지원 등, 선진통관체제의 확립, 중소기업 지원 등 규정을 모두 포함되는 법안이다. 더불어 안전관리에 해당 장과 절에 관세의 부과‧징수와 관련성이 낮은 현행 관세법 조문을 재배열하였고 전체적으로는 관세법 분법과 추가법률제정의 두 가지 목적을 모두 달성할 것으로 판단된다.
Abstract
This study proposes the reorganization of the customs law with the change of trade environment. Based on the previous studies and the implications of major countries(US and Japan), the “Customs Law” including the purpose(taxation, collection, customs clearance) of the Customs Law and the “Tariff Policy and Safety Management Act” including the tariff rate policy and the border safety management were proposed. The Customs Law shall include the General Regulations, the imposition and collection of customs duties, taxpayers' rights and complaints procedures, means of transport, bonded areas, transportation, customs clearance, penalties, investigation and disposal. The Tariff Policy and Safety Management Act. shall include: 1) tax base and transaction value method(financial income, trade cooperation, international trade practice), tariff classification and custom tariff (financial income, industrial protection, price stabilization, trade cooperation) tax reduction and/or exemption (industrial protection, international trade practice) and 2) logistics security and border safety management, special clearance and trade facilitation, international exchange and cooperation, tax support, advanced customs clearance systems, and support for SMEs. In addition, chapters and sections on safety management have rearranged the current customs law provisions that are less relevant to the imposition and collection of customs duties.
