초록
중세 종교재판을 떠올리면 이단 심문이나 마녀재판을 떠올리게 되고 이는 무자비한 고문과 증거 없는 자백으로 얼룩진 부끄러운 형사재판역사의 감추고 싶은 과거로 인식되고 있다. 하지만 중세종교재판의 어두운 면속에는 그 이전 로마법상의 형사절차의 계승과 성경적 형사재판절차의 도입과 더불어 근대 형사법절차의 맹아가 함께 자라고 있었고, 이단 심문과 마녀재판 등의 암혹 속에서 희미하지만 적법절차와 피의자, 피고인에 대한 고민과 고려가 촛불처럼 타오르고 있었음도 간과해서는 안 된다고 생각한다. 이러한 전단적(專斷的)인 형사재판의 왜곡 속에 잔존하고 있는 미세한 고려의 단초나 근거가 무엇인지 밝혀보려고 하는 것도 의미 있는 시도라 생각된다. 따라서 중세 종교재판을 암흑으로만 보는 입장을 포함하여 그 실체를 다각적인 측면에서 바라보면서 근대 형사사법절차에 미친 영향과 함의를 탐구해보고자 하는 것이 본고의 목적이다. 종교와 법학의 접점으로서의 법사학의 필요성과 제도의 연혁적 연구나 비교법학적인 탐구는 여러 가지 차원에서 법학의 내실을 다지는 연구 분야라 할 것이다. 또한 중세종교재판은 학제적 연구로서 최근 주목을 받고 있는 젠더법 연구에도 하나의 시사점을 제공해줄 수 있을 것이다. 본고에서는 중세종교재판에 대한 부정적인 인식을 걷어내고 고대 형사법제도가 기독교의 영향으로 재구축된 중세 종교재판의 무대에서 다양하게 시도되고 있는 제도들이 근대 형사법제도의 구축에 다양한 영향을 미치고 있는 사실을 발견하였다. 향후 구체적인 제도에 대한 보다 심층적인 연구가 필요한 시점이 되었다고 판단된다. 이러한 작업이야 말로 근세 나아가 현대 형사법제도의 발전에 많은 시사점을 던져주고 알찬 내용구축이 가능케 하는 발판이 되리라 생각한다.
Abstract
Medieval religious trial reminds a heretical inquisition or a witch trial, which is perceived as a shameful past marred by ruthless torture and confessions without evidence. In the dark side of the medieval Inquisition, however, the bud of modern criminal law system was growing along with the succession of criminal procedures under the Roman law and the introduction of the Bible, and in the dark of the heretic and witch trials, although it is obscure. I think it should not be overlooked that consideration of the legality lies in the process of inquisition. It is also thought to be a meaningful attempt to find out what is the basis of the consideration that remains amid such distortion of criminal trials. Therefore, the purpose of this article is to explore the implications and probability of modern criminal justice procedures by looking at the reality from various aspects. The necessity of study law and history as the interface between religion and law, and the systematic study and the comparative study of the system, will be nutritive element for strengthens the inner workings of law at various levels. In addition, the medieval Inquisition may provide an implication for the recent various study like gender law study, which has been in the spotlight as a scholarly study. This paper tries to remove the old negative perception of medieval religious trials and shows the new bright side of medieval institutions, where the ancient criminal justice system like Roman penal law was rebuilt under the influence of Christianity. Inquisition gave various influences on the establishment of modern criminal justice systems at both good and bad side. That is because more in-depth study of the specific medieval legal system will be needed. I think this work will serve as a stepping stone for the development of modern criminal law system.
